FB-1 category that has children...

Hello there - Just want to know,,, based on experiences that are in FB-1 category (unmarried son and daughters of us citizens 21yrs and older) that has children,is it possible that the consul or the preliminary interviewer will still ask their birth certificates even they are not included in the petition? I have a 22 year old son but i only have is the baptismal certificate but hes not included in the petition due to his age. And usually what questions they are asking with this category. Most I see is more on fiancee and spouses... :-)

Appreciate your immediate response. I have an interview next week.. :-)

Are you the primary beneficiary of the F1 petition? A 22 year old son of an F1 beneficiary is not eligible for a derivative visa. In fact, a 22 year old is not eligible for any sort of derivative visa unless they're the spouse of the primary beneficiary.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Are you interviewing for an immigration visa next week? Who petitioned for you?

Although your 22 years old has aged out, he may be protected under the Child Status Protection Act (CSPA).

YOUR SON MAY ACTUALLY BE ABLE TO IMMIGRATE WITH YOU. YOU NEED TO ASK THE IMMIGRATION OFFICER AT THE INTERVIEW ABOUT YOUR SON AND HOW CSPA CAN HELP HIM.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks for the response Jim! I'm the primary beneficiary. Just want to verify if during interview they still need to verify the birth certificate of my son. The reason why I ask this because there is some inconsistency of the bc thats why i dont want to show it.. Actually he has no intention to follow me...

You'd be surprised what sorts of information they can get and ask you at the interview. Never lie or try to conceal anything.

If he's not applying for a visa then you shouldn't need to produce his birth certificate.
