Hello everyone

I just want to introduce myself and say hi.

Im 23 years old and I'm from Germany. Me and my boyfriend want to file the petition for K1. We are in a relationship since May 2010. We want to file as soon as possible when we have all the paperworks. We will live soon in the sunshinestate Florida. The reason why I registered here is why I wanted to find some questions about the K1 process.

So hello from Germany and ask me if you have any questions :)

Welcome to VJ.

If you look at the top of the page you will see the link to the Guides. There is information in there for the K-1 Visa. How the process works and what paperwork you will need.

Best wishes in your journey! :)

hi, you can start by reading the immigration guides for k-1 visa fiance.e on this page the form you will need is the 1-129f,it should take about 5 to 6 months to complete, when you go to the interview and get approved, you get 6 months ,when you arrive in the united states you have 90 days to get married. then you need to file for adjustment of status,1-485 for permanent resident card, another form 1-765 for employment authorization, optinal is the 1-131 traval, the cost is 1,070 to file for adjustment of status.then of course you can go the married spouse route 1-130- cr-1 less money, you get the green card you can work, you can get a social security card,it could take as long as 9 months,or more.good luck on what ever you decide,

The K-1 is complicated as it requires you to file for Adjustment of Status ($1,070) afterward. In addition, you can't get a driver's license and you can't work for about 3 to 5 months. Therefore I would advise you to go the CR-1 route. You both can visit each other as members of the VWP, so you guys can get married in Germany or the United States when and where you want.

Afterward, your husband files an I-130 petition for you while you are enjoying your honeymoon on Key West. When the 90 days are over you return to the Fatherland and wait for the U.S. consulate in Frankfurt to contact you. You'll submit the usual paperwork which now includes your marriage certificate and you will have an interview.

Once is all said and done, you will receive the immigrant visa (the K-1 is a non-immigrant visa) to the U.S., have 6 months to "activate" it, and the moment you arrive in the U.S. they will put an I-551 stamp (code for Green Card) in your passport. You can get a driver's license and work from day 1 on. No AOS, no waiting time. Much smoother. Much smarter.

So why would anybody use the K-1?

Well, there are reasons. For example, if the foreigner has no way to use the VWP or to get a B2, then the K-1 is oftentimes the only way to get to the U.S. In such a case the K-1 route makes sense.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.
