Well, South Dakota's Senate passed the bill that their House passed, so once it's signed by their pro-life republican Governor it becomes law, meaning the first direct challenge to Roe vs Wade with the new Supreme Court. This is big.

Well that is the way it should be done. Each state making it's own decision. Roe v Wade is BS, there is NO constitional right to an abortion.

This is a really tricky subject. On the one hand, after a miscarriage, it hurts me to think that women choose abortion at all. On the other hand I dont like the idea that women who are desparate to end a pregnancy will do so in unsafe ways. Especially since they aren't allowing it for women who have been raped. While I personally still could not abort, I can understand how some women might feel they cannot go through the pregnancy. I do not like that some use abortion as a method of birth control, but how do you monitor what a persons reasons are for getting one?

I don't see it getting overturned. As far as I know, the (slim) majority of people in this country support at the very least, a limited right to choose. Perhaps the SC will say that indeed it IS a states' rights issue... should be interesting. Stay tuned.

I'm glad I don't live in South Dakota. I'm pro-choice, and always will be. Making abortion illegal would be risking many women's lives.

Next week it'll be bible belt states saying any kind of sex other than 'between married people' is banned..oh and no oral sex EVER - also they should probably masturbation for religious reasons /sarcasm

I hope SDakota don't have the death penalty - otherwise this new 'law' will be the height of hypocrisy.

As for States devising their own laws - don't they ALL have to abide by Federal taxes? And immigration? And working rights? And voting?

Will these be next?

Will one State suddenly decide to remove rights for black people or Asians? What if a 'white surpremacist' party gets power in that State?

Why not just declare independence and have done with it...

Of course Pro-Life is going to challenge this, they counted on it! This is like a set up. It's like they waited til Bush got his 2 men into the Supreme Court. I'm afraid that now the Supreme Court will slam the door on the Abortion issue and say that this law is constitutional. It's got that clause in it that abortion is okay in cases where the mother's health is at risk, which other laws didn't.

"… I think [Chief Justice John] Roberts and [Justice Samuel] Alito are very persuasive collegial types who may have more impact than we dare hope." Is that what the new justices are? Scary.

Call me crazy.. but I have a hunch that this will get challenged in Federal Court.. and if it happens to make it to the Supreme Court, that I think this law will be done away with and Roe vs Wade will be up held, simply on the matter of precedent. It's going to be very hard to get the Supreme Court to overturn a law that was previously already decided by the Supreme Court.

I think this whole big she-bang over abortion is just stupid. Why can't people have the choice to do what THEY want with their own bodies? Would I recommend or try and get my girl to have an abortion if she got pregnant.. no, I wouldn't... Would I tell you, a stranger, that yoiu were wrong for having one.. nope... only you can tell if you were wrong or not in deciding that...

Damn, that makes me angry.

If it goes to the Supreme Court, Roe is overturned and abortion goes back to back-streets and coat hangers, I will be taking my husband and moving back to the UK. No questions asked. Personally, I cannot and will not live in a country which is so short-sighted as to fail to see the implications of such a decision.
