Hokay, so here's the deal.

I was at school in 2009 and did not file taxes. As such, I will write a letter of explanation, get proof of non-filing, and attach copies of my acceptance letter and degree result letter to the application. But which, if any, box do I tick?

I did not 'file a Federal tax return for the past three years', so the first box is inaccurate, and though I am enclosing information about the past three years, I will not technically be submitting a 'federal tax return transcript for the second most recent year', so box 2 is inaccurate.

In your case both the boxes of item 25 should be left blank. I guess that you either have enough current income or a joint sponsor. All the best.

Thanks! Yes, I have enough current income, but will probably use a joint sponsor in case they are inclined to give us any trouble about my past filing.

That being the case, do I still list the amount of my federal filings for 2008 & 2010 on the form, leaving the center box for "2nd most recent year" blank, or do I leave that portion entirely blank too?

Sorry, I didn't realise that you filed 2010 return.

You need to select the item 25 box and enter 2010 & 2008 in the Tax years (most recent & 3rd most recent - leave 2nd most recent blank). Then explain why you didn't file federal tax return in 2009 in your explanation letter.

If you want to send the 2008 tax return or IRS tax transcript, the select the second box also.

Ah ok! That makes more sense...kinda. Hard to understand how they don't foresee some of these situations and make tick boxes by year or something.
