Timeline

Hi guys. I sent my AOS forms into the Chicago lockbox at the beginning of September. I had a medical over a year ago (I've been here nearly 2 years and only just now been able to file AOS) which expired on September 29th. I figured that a whole month would mean that we'd be fine for the forms but I've just received an RFE saying that the check was in the incorrect amount. Now the medical has expired. Would this mean I'd have to get a new medical done or with the pink slip on top would they be able to see that they received it before it had expired? Just wondering as $275 is a lot of money to drop again on a medical.

I would think you shouldn't worry about it. If you sent your medical before the one year mark then you should be fine. the RFE has nothing to do with it. Maybe more people can reply to you. Hopefully you won't have any problems :)

Why don't you cal USCIS?

11/09/2011 Text/Email stating EAD card is in production 

11/15/2011 EAD Update

11/16/2011 Approval of EAD sent by mail

11/18/2011 EAD in hand

11/21/1011 Applied for SSN

11/26/2011 Social Security Card in the mail!

I'm hoping we don't need to have it done again as it took a while. Thank you for your answer though. I'm going to call USCIS in a while and find out for certain if I need to get one done again. I'll update this when I know so that everyone else knows.

A timeline would be helpful. If you've been here nearly two years, then it seems like your medical in London had to have been at least two years ago. What visa? What was the date of your medical in London?

Sorry, it's a K-1 Visa I came here on. I had to have a second medical when I was here as the other had expired. So I've been through 2, hence why I'm trying to avoid a third. Actually just realized it's been close to 3 years. Heh, I'm not that bright.

Well you did get a second medical, and you left it in a sealed envelope right? I honestly don't see why it would be a problem

Yeah the envelope is sealed and all. I just know that it expired at the end of last month. Thanks for your responses guys, they're helpful. :)

More info needed--

You said you didn't pay the correct amount. Normally they send the whole packet back with the check that was incorrect. Is that what happened to you? Or did you get a receipt (NOA) that your packet was accepted? Date printed on the receipt?

Yes Nick, they just sent the entire packet back with the check but with the pink slip to put on top of the packet. I mailed it back with the correct amount so we'll see what happens I guess.

Then the mailing the first of September doesn't count. You started over. On the other hand they may not even notice the year 2010 and just see September and carry on. Yes, just wait and see.
