Hello,

My name is Ileana and my husband and I filed the I-130. We just came back in August from Ciudad Juarez from our interview but my husband was denied his visa and was told to come back in 1 year. Frusted because of the violance that we are living in Mexico, we made the bad choice of trying to cross him illegally. This Monday he was detained by immigration and is being deported this very second. Does anyone know what are our chances of still getting a visa and if a perdon is what we need to do now???

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Im pretty sure there is a 10 year ban. Was this just a tourist visa?

MMM get an attourney, but Im pretty sure your screwed. Sorry, this must be horrible for you. Why not move to somewhere safer in the Mexican republic?

Fell in love on a missions trip in 2005, got married in 07, got pregnant and started IR1 visa process in 08, had baby number 2 in 10, and its now 2011, and we are just now finally getting to the end of this long road. (The mail from the embassy never arrives to my home, causing us trouble. Fingers crossed and prayers going up! Both kids born and raised in Mexico and American citizens by CRBA:

I really don't know what the sanctions will be, but it won't be easy to get the visa now. You can count on that. He may be eligible to file a waiver when you eventually go back to Juarez, but it's going to be an ordeal I imagine. Like others have suggested, I would recommend that you talk to an attorney.

On the other hand, I agree with Nicci. While the volatile security situation in Mexico has everyone on edge, and it really is a horrible situation, there are dozens of places in Mexico that one can make a good life for himself, of which most have remained almost completely untouched by the insane violence Mexico is experiencing (and likely will continue to experience). Puerto Vallarta, Cancun, Los Cabos, Mexico City, Guanajuato, Puebla and Guadalajara (at least for now) all come to mind.

2004--2005 - Many subsequent visits to Mx ensue to be with my love; engaged in March 2005!

04/??/2005 - I-129F is filed from within the US

06/09/2005 - Zinker moves to Mexico

09/??/2005 - I-129F is approved

10/15/2005 - Interview in Cd. Juarez and subsequently approved for a K1 Visa!..But visa is left in Juarez

10/17/2005 - Due to unexpected pregnancy and a job offer in Mx - we decide not to pursue the visa and it expires :(

01/04/2006 - Married in Mexico

10/09/2011 - Two children later and a comfortable life in Mexico... Preparing to file I-130 in December 2011. Stay Tuned!

It would also be helpful if you provided a timeline for all these events.

Denial and being told to come back in 1 year is usually due to drugs, MJ.

OP, you're going to need a competent and experienced immigration lawyer.

A denied visa and a subsequent removal...an extreme hardship waiver might be in order.
