First of all I want to thank everybody, you guys became my guide for almost a month while preparing my adjustment of status application.

I decided to do it myself because.

- I don't have any money to pay for retainers fee (they are asking $4000).

- the said firm filed my I-130 F2B years ago got a RFE and I almost did not make it before April 2001, they forgot to send my dads green card copy (elementary mistake)

- Got another RFE for my siblings (consular processing) co sponsors proof of citizenship, they did not give us a list which documents to provide and just sent what we filled up, I don't think the lawyer checked the documents.

having said that, I had some trepidation to retain the same firm , and besides I cannot even afford them.

Here's my case, I overstayed ,filing adjustment of status under 245i , no criminal record, no dui ,never been arrested , no deportation or anything. I just came here B1/B2 on 1999 and went under the radar.

My priority date is March 21 2001 (current on Sept VB), sent my packet to Chicago Sept 24, it was accepted Sept 26, got my notification email/txt Sept 29, Oct 3 received two I-797 for my I-485 and I-765.

The hardest part was the affidavit of support, and this is causing me some paranoia, last year my PD was current, but had some problems finding a co sponsor because my dad was unemployed , my mom and dad files joint taxes, their 2008,2009 and 2010 tax return shows that their earnings was above the %125 poverty guideline, but he lost his job aug 2010 and received unemployment for the first time ever, and then the great F2B retrogression :crying: . Anyway he's now employed since Feb this year and back on track, their combined income is more than they made last year.

The following are the documents I sent.

I-485 and I485a (245i)

proof of physical presence are .

- 1999-2004 Health Insurance card

- 1999 Cell phone contract and receipt

- lots of sales receipts with my name and signatures. The receipts without my name but with my signatures I included scans of the credit cards and debit card used on those transactions .

- postmarked letters.

- Picture with a date on it.

I have more documents , but I'll just bring it with me if God willing they will give me an interview date instead of a denial letter. I don't have any government documents for obvious reasons. :blush:

- 2008 , 2009 and 2010 joint tax return with W-2s (all above the %125 poverty guidelines enough for household of 7, we are currently just 3) .

- 2011 recent 6 months pay stubs of my mom and employers letter

- 2011 Feb to Sept pay stubs of my dad, and employers letter.

My questions are

1) my dad is only working for 8 months, will this cause a red flag ? They might think that his employment is not stable enough. Is being unemployed in the past can cause trouble ?

2) My dads employers letter did not include the salary, it just said the date he started and position, and if they have any question just call him, it was signed by the company president himself. It has a letterhead ,address, email, phone and fax number. My dad is working per/hr ,and sometimes he makes more from overtime, time and a half on holidays, so it's hard to determine the exact amount and maybe this is the reason why the salary is not included in the letter but we do have all his recent pay stubs . I just calculated the regular hours to determine the expected income, the figure that I put on his I-864 is actually lower than what is reflected on his pay stubs because he worked overtime , but I don't want over estimate his earnings, will this cause a problem ?

Just and update:

USCIS sent me an appointment letter for my Biometrics on 9/30 for 10/26 , I almost did a walk-in but decided to just wait, my appointment was 3PM but got there around 2PM, and there were no other applicant , the guard was not even there, and he just came behind me, maybe he was outside having a break, so I asked the gentleman inside "there's nobody here, guess you are not busy ? " he told me "well they were here this morning and you came at the right time " I replied "But my appointment is 3PM" he said "then you can go home early", so I asked again "Will you take my fingerprint if my appointment is 2 weeks away ? " " He said if there are no other applicants they will, they are all very nice there. People who have an appointment that day regardless of time came there earlier and finished their biometrics. So I assume that the best time if you want to do a walk-in is do it around 3PM. he gave me a clipboard to fill up and told me to give it to the guard, the guard ask me to show all my 10 fingers and my ID, and after cross checking the form, gave me a number , I went straight to the biometrics machine, the lady took all 10 fingerprints , signature and photo, she asked me if I want to look at the picture, I said yes but never actually look at it and said that's ok. Everything only took 10 mins.

A week passed after biometrics and no LUD on my case and this morning I was thinking of calling the FBI, because I read that others had their EAD processed within a few days after biometrics. This afternoon I received a txt message that my online status was updated, combination of anxiety and paranoia sets in , there were no PC around to login and I'm too cheap to have a smartphone so I cannot wait to get home. I was expecting that the LUD was about EAD or the dreaded RFE, but to my surprise it's an update for my I-485 saying that USCIS sent an interview appointment for December 7 , no touch yet on my I-765 :o , this got me worried because maybe they are planning to deny me on my interview and they think that it is pointless give me an EAD. Well I hope this will not be the case.

Anyway just in case I got approved on Dec 7, it will be just less than 3 months since I sent my AOS to Chicago.

Just and update:

Got my interview letter from mail this morning, no update yet on my EAD, I noticed that the Priority date is the same date as the receipt date (Sept 26 2011) , I hope there's nothing to it, anyway I read that this happened to some filers and USCIS will actually base the priority date on the I-130.

Time flies , just an update , I think the interview was just a formality, the IO asked me basic questions and just go thorugh the paper works, after a few minutes I noticed him checking his computer, and I asked "is there any problem ?" he said "no I'm just checking if there's a visa number avialable" , it took him some time because he said the computer was too slow and he asked a different officer to just do it on a different computer, and after that he stood up and led the way outside the office and congratulated me, he asked if I used a lawyer and I said no, he was shocked and told the other officer "this kid did not use a lawyer and he's on 245i " , he said to me that I really know what I'm doing. Anyway I moved out of state , California is a mess when it comes to job hunting, plus the deficit is now $16B so prepared to be taxed to death, found a really good paying job that I love a couple of months after I got my green card, still miss California and her nice weather but the opportunity to make a decent living is somewhere else.

FWIW, I'm not expecting California to be "taxed to death". Prop 13 made it difficult for the state legislature to raise income taxes. They need a 2/3 majority, and they'll never get it. That's why Jerry Brown put a measure on the ballot basically begging Californians to increase their own taxes. He using the worn out "I'm going to have to fire more teachers and cops if you don't raise the taxes" ploy. Most everyone I know is planning on voting against it. People are getting a little sick of the government asking the people to pay more in order to save government jobs when the government isn't doing a damn thing to help save private sector jobs.
