October 2011 AOS Filers!

Hi there, and welcome! I think the reason that most people apply for EAD as well as GC is because technically, green cards can take up to two years to get, where as EAD is usually no longer than 3 months. I don't know why this is, or if this is still the case, but this is what I was told so it is often safer to just apply for EAD and AP since it could take while for GC and you can't leave unless you have either AP or GC. I think having AP even if not used makes people feel more secure for "just in case" they need to leave the US. Anyway, it looks like lately GC's come through shortly after EAD approvals anyway, so probably nothing that will concern you, just a bit of info. :)

i see. i ddnt know it can take up to 2yrs to get tha GC. anyhow can i still apply for an AP and EAD separately? we were planning to go back to the Philippines by next year. i will surely be needing that AP. i really think i can have the GC early next year. i feel sad already.

I don't have my EAD in hand but I have been approved and its in production.

I am not planning on working yet but I don't think I'd get in hot water

Correct - I have my EAD just don't have the physical card/piece of paper whatever it is.

I was approved on the 15th and I haven't had my card yet.

The date of validity on the card starts from the approval date so it wouldn't have been an issue.

Does the uscis website say they mailed your card or ordered production? Mine still says they ordered production on the 14th, will it change to we mailed?

just checked on my case. ang they mailed me a notice yesterday. interview on january 18. yey! can i come alone? my hubby is currently deployed!

Sure, bring any documentation regarding the deployment.

I believe that AOS interviews can only been waived if an interview has previously taken place, i.e. someone was interviewed as part of a K visa process (fiancé visa). If you or your partner has never been interviewed by USCIS as part of an immigration procedure, then you have to go through the interview. :)

Congratulations to those who have recently got their EAD applications approved and for those who have been set interviews or had their GC applications approved! My case was transferred to California and I have yet to hear any news on my I-485 application. As it is Christmas this week, I am not expecting to hear anything until the New Year. So with that in mind I am going to try and stop obsessing over everything and just enjoy Christmas, especially as my family are flying in from England this week and staying until the new year :)

So I want to take this opportunity to wish everyone a very happy holiday and a blessed and fantastic new year! I'll be back in the new year, i'm giving myself a vacation from VJ lol. Kaibosh - GOOD LUCK with your interview tomorrow :)

Naturalization Journey (Based on 5 years as a PR):

November 21st 2016 - Sent N-400 to Dallas Lockbox.

November 30th - Check Cashed.

December 1st - Email/Text Notifications.

December 8th - Hardcopy of NOA received (Priority Date 11/25).

December 9th - Biometrics Appointment Letter received.

December 19th - Biometrics Appointment.

January 4th 2017 - "In Line" for Interview.

June 9th - Online status changed to "Interview was Scheduled".

June 12th - Interview Letter received.

July 19th - Interview (NYC). Requested a "delayed Oath" for after September 4th 2017.

September 11th - Oath Letter received. Honored my request for a delayed Oath Ceremony. 

September 14th - Oath Ceremony.

But if that was the case, wouldn't everyone who was adjusting status be granted their conditional green card without an interview? And if it is received without an issue, what would the odds be that USCIS would require you to have an interview for ROC?

Not everyone is AOS-ing from K Visas. I, for example, am AOS-ing from a F-1 (student visa). I was not interviewed at any point during that process since the F visa is a non-immigrant visa. So, we had to had an interview for AOS since we had never been interviewed by USCIS for immigration purposes.

I don't think they do interviews at all for ROC, you just have to file, pay the fee, and do another round of biometrics. I'm not 100% sure on that but I believe it's correct.

I completely forgot that there are other visas out there :bonk:. Everything makes much more sense now, thank-you!!

Today I got the RFE in the mail (they were pretty fast) and they want exactly what I suspected: proof of immigration status of the household member (form I-864A). I feel MUCH better...
