Does the petitioner get interviewed or is it just the person who they are filing for? Does it make a difference going to the interview?

Is there a form somebody can provide to see what is needed to bring to this interview for USA Citizen filing for Mexican Citizen? We plan on going together but just want to see how everyone knows what is needed besides what they send you in the mail, if there is an online site I can view?

No the citizen does not get interviewed and does not have to attend the interview.

The consulate you will use has complete instructions available, visit their website (google "US consulate Juarez") and go to information on K visas.

If you want a letter from your landlord as proof of relationship for the interview, it is fine.

You could say that. After all, it is HE that is applying for the visa. Some consulates allow the citizen to attend. Kiev does and I attended with Alla because she was nervous also. It was nothing to worry about at all. Even if you attend and are allowed in the interview (I was) they will not ask you any questions and you best keep your mouth shut or they will tell you to leave.

US doesn't give out police certificates.

You don't need a police certificate for time spent in the US. The K1 instructions almost always give a list of countries for which no police certificate is required, and the US is one of those countries.

How did he enter the US? Did he have a visa or border crossing card, or did he just hike across the border (i.e., did he enter illegally)? How did he leave the US? How long was he in the US?

If he was in the US illegally for more than six months, and if the US government knows about it, then he probably incurred a ban when he left.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

For others who are reading, the advisability of a petitioner's attending the interview (or, being on the consular premises during the interview) varies by consulate. In general, it NEVER hurts and may very well help if the petitioner is there (he or she can give his or her U.S. passport to the beneficiary, who can show it to the consul). In some countries, it's crucial that the petitioner be on the premises -- Ecuador is absolutely one, and I understand that the Dominican Republic, Jamaica, and probably Haiti are others. The petitioner does not HAVE to be interviewed, but the consul may invite him or her in, to get a better sense of the bona fide nature of the relationship.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thank you Tbone. Yes there are some difficult consulates where the presence of the US citizen can and does make a difference. I have not heard that Juarez was one, but others do read the forum also.

As for me, I would recommend anyone going if they possibly can.

Some people said that they go with the petitioner to attend interview but not to be interviewed. But I make clear to my fiance that he has to come. It would make me feel better when my fiance with me at that time.laughing.gif

That is one of the keys also. My wife wanted me to be there and IMO it never hurts for the petitioner to attend. In this case there are some additional issues as the beneficiary was in the US illegally for some period. The big things to be very sure of are did they ever work, use a false SSN or fill out any government or private paperwork that will document their time in the US?

We had our interview at the embassy in Dublin, Ireland. My wife (the petitioner) was not required to attend but she came along. The officer conducting the interview made it clear that she wasn't to assist me with answer unless the officer directed he to do so. probably 75% of the questions were directed at me alone, the rest we could both answer.

The officer was very friendly in the interview, after all the nerves, it felt more like a friendly conversation than anything else.

My information is that at Juarez (the usual consulate for Mexican applicants) the petitioner is not wanted at the interview at all. I found this also to be the case in another country where I was politely but firmly asked to leave.
