Interview in New Delhi

Timeline

How effective would it be if I go to the interview with my fiance? We were unable to submit our papers to VFS, due to 2 holidays between now and Oct. 12th. Our NOA 2 expires on October 15th. Anyone that has gone through something like or may offer their 2 cents, please advise. After reading some posts on this site, I see that there is a possibility our petition may be sent back to NVC/USCIS??

If you don't submit your papers to VFS prior to your interview, they most likely will not accept them at the interview and will issue you a 221(g), maybe even a denial. It will help a little if you front-loaded your application but you're still going to have issues with not turning it in.

Your presence at the interview could be very helpful...maybe it will save your from a denial and just put you into AP/AR. If you have any red flags such as different religions, age gap, beneficiary is male or engagement photos that look like wedding photos, I would highly recommend you be there if you can afford it.

Are you sure you can't submit your documents prior to the interview?

If you don't submit your papers to VFS prior to your interview, they most likely will not accept them at the interview and will issue you a 221(g), maybe even a denial. It will help a little if you front-loaded your application but you're still going to have issues with not turning it in.

He went to his local VFS in Punjab and they told him he can't submit them there. Then my dad called the VFS office in New Delhi and they told him that my fiance can submit papers in New Delhi. So my fiance took a 12 hour bus ride over night to New Delhi and he got there at 4 am (he was told that Oct. 5th would be last day they woudl accept his papers). So he waited utnil 8 am he walked in and they said no its too late you can't submit papers here. So then my dad called VFS again last night and he said well you told me that he coudl since interview is on 12th. All they said was sorry sir, we did not take into consideration the Columbus Day holiday. The guy at the VFS told my fiance that he can take the documents to the interview and after that it would take maybe 2-3 days for processing. I don't believe that. He is a male, we are not different religions, our marriage was arranged, and there is a 2 1/2 year age gap. He is 29 and I am 26.

Just 5th is gone by. Try your best to submit all the documents you are able to before your interview at VFS along with the courier fee and take a receipt from them and then you may get a G221 for the missing one. Yes, presence of your spouse helps with the interview, though he/ she may not be allowed inside.

Be positive and try your best and hope for the best.

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

It looks like you have no red flag per say...

If you can not submit any documents to VFS, you are most likely going to get 221g form to submit additional documents.

I can tell you if you are in CR1... your NOA2 will not expire... But your's is different case.

you got go with what ever happens now.... try to submit papers to VFS (I know you have diffculity there).
