Greetings,

Newbe here.

I hold an E-1 visa and have lived and worked here (in the US) for the last 6 years under this visa (was renewed once).

The visa expires 11/2013.

I have begun an EB-2 process 6 month ago. Lately, my I-140 was approved. My attorney wants to submit the I-485 ASAP but I have my concerns.

Come next week I am scheduled to travel to Europe (work) and come back 5 days later.

My question - do I need an Advanced Parole or does my visa covers me under Duel Intent? I guess my question is, once the I-485 was submitted, may I face some resistance coming back to US soil with no AP?

Hope I was clear - any references would help,

E visa is not dual intent; only H and L. You will need AP to travel or you will need to wait to submit your I-485 until after your trip.
