Im new to this and I am hoping you people can help me.sorry for bad english. I was on a training visa here and met my american husband and get married last year and we had the interview 3 months ago. Everything were happy and ok but I notice husband starting to act weirder. He goes home late, hides his phone all the time and go out all the time.at first is ok, but 2 weekends ago I lied and told him im going out with friends.when I got home, I caught him messin around with another woman. She didnt know hes married. I kicked him out of the house but he got so mad and starting threatening me. He told me if I dont take him back, he will harrass me and call uscis to cancel my green that I recieved 3 months ago and he will ship me back. Did not believe him since hes reallu nice guy Now im scare now that he already did. I dont want him to take my life. How can I call uscis and ask them if he stopped cancelled it? Im very scared. I dont wanna go home.i dont have a life there.

Thank you alot people. Im so very depressed now and scared.i know hes crazy. I want to divorce and continue my life. But if I leave him, it also means I cant stay here anymore because I dont know if I can petition myself under what grounds? Or what if he totally disappears or leave my case hanging or not cooperate with me to remove my condition?

Cheating is Bad, and usually means there is a problem much deeper than the act alone of cheating,you said hes a nice guy, have you talked to him? Are you only hurt or do you no longer love him? sounds to me like things went bad pretty quickly?? The other person is correct you have rights here in the USA but you should Put aside what happened and try to either work things out or work things out in an amicable way even if you do decide to divorce. If there has not been any physical abuse or threats that would make you believe you are in danger of being harmed you really should try and work things out. Also, if you plan to stay here in the USA it seems to me you should think of who helped you to be here, again this is based on there not being any violence or danger to you.

There are too many people who use protection orders for the wrong reasons, and as such they are abused and misused. They can have consequences on his employment, overseas travel and even raise his insurance rates. The courts are full of these protection orders that have been filed to evict guys from their homes without cause or any real threat to the person filing them, to make room for new boyfriends and even as leverage in divorce and custody case, they are not to be taken lightly as the previous post would have allowed you to believe.

but again, if there has been physical violence or you have a genuine concern for safety then it is designed to protect you and must be considered. You may even wish to let him know that if he persists on harassing you you will have to file a protection order and that he should Google it and see what the consequences are.

Good Luck and Try not to feel too bad, there are a lot of good people to support you.

I wouldnt spend 5 minutes trying to work this out with him. The lies & the new bed mate is enough for me. This occurs right after you marry? Please.

I also disagree with any thought about how he helped bring you here. The idea should be to do something FOR you not To you. Bringing you here to do this to you probably wasnt what you had in mind when he brought the idea up or when you got on the plane.

Have you been harmed? Absolutly. Mental abuse can be much worse than being assaulted. Danger? You are in danger anytime you have to be put in this position.

I also wouldnt spend even one minute on the affect a restraining order would have on him. He decided to disrepect you & the marriage. The restraining order protects you from being charged with domestic violence which could have a huge affect on your future legal status in the USA. You have to try to protect yourself & create the image that you are trying to use lawful means to build a life here. I didnt say to take this lightly at all. Take it seriously & get it done. Even Nichole Simpson tried to protect herself. She didnt take it lightly but paid the ultimate price.

Threating him with taking action as the other member says just causes you to be in a difficult, dangerous position. Dont make threats. Do what needs to be done.

Forget trying to be nice. Or live with the fact he will have others in bed ect. If you allow that you have nothing to complain about. Dont be a victim.

What price should you pay for wanting what is only right. Dont give up your dignity as others suggest. You cant get it back & dont owe it to anyone.

First thing you need to know... there is no way possible that he can cancel your card. There is no way he can get you deported. A lot of USC spouses watch too much TV and think they can call Immigfation to get you deported... totally wrong! You have a GC. This makes you a lawful resident. And yes you did get your GC through marriage to this a**hole but your marriage was in good faith.

If you do not want to try and work things out with him (counselling etc) then you can get divorced and go down the route of the I-751 waiver. If you do this, just be sure to have all your evidence together, as you'll need to prove marriage was in good faith.

Keep strong ok!! Im sorry this happened to to you. Its tricky coz of this whole visa stuff. But you'll be ok!!

1. divorce or stay together, you have two years from the 'issuance date' printed on your green card to remain in the USA.

2. divorce? you will not be 'sent home' by uscis simply because of divorce.

3. after divorce, you can file Removal of Conditions packet without him, is special category (not vawa at all).

He can't cancell your GC, as long as the marriage was in the good faith.

Divorce him and get an order of protection.

He is not obligated to support her. He obligated to a contract with the uS government to repay any means tested benefits if she obtains them.

True but she can use the 864 in court to help obtain support. Or I suppose as you say apply for U S govt benefits & let the govt deal with him. I would do both.

Ning, you are a Platinum member, and I can't believe you would tell someone that the I-864 forces the petitioner to support them. You obviously don't know what you are talking about, and you are spreading falsehoods here. I will agree with you that I have read that in family court lawyers have used the I-864 to get support to win a case requiring the citizen to pay support to the immigrating spouse. But I have also read that it is a long shot, and usually it does not hold up in court. If she is desperate, and finds herself alone and without support she can try the meanse tested benefits, and then the government can deal with the petitioner.

Try to get your information correct, because as a Platinum member you shouldn't be leading people astray with your false information.

Wrong wrong wrong. The I-864 says three things about this. 1. that he will maintain her at at least 125% of the poverty level and if he doesn't she can sue for this. 2. That his assets may be considered available to the person when applying for means tested benefits and 3. That he may be asked to reimburse any government or private agency that supplies means tested public benefits.

Read the section on page 6 of the I-864 under "What does Signing the Form I-864 Require Me to do?" and it very clearly and explicitly covers item 1.
