unemployed single mom but receive court ordered child support

I have been reading and searching about the fact that I am unemployed at this time but receive court ordered

child support and will for the next 10 +. Between what I filed last year 2010 taxes and my child support, I more than

make over the 125% poverty guidelines.

My attorney hasn't been real helpful with our questions and we have found VJ members to be much more knowledgeable

about this journey, so I wanted to check here and ask is Montreal will allow me to show tax return for 2010 and my proof of

child support court ordered and accept it as on going stable income?

I have searched and found several different woman that have stated that they only make child support right now and along

with there tax return, they were able to sponsor their fiance.

My attorney says I will need a co sponsor. But again, this attorney has told me some really bad advice and it goes against

everything I have read.

What do you think?

interesting question.. i will wait to see what is said..

but on another hand.. i don't think taking money intented for your children should be used to go towards your personal life.. to me.. its not right ..

My child support is not being used to fund this visa process. My fiance is covering all that. My child support goes to provide all the needs of my children, like shelter, food, clothing, school

supplies etc, just as it did before I got divorce.

None of my child support goes for frivolous things, but being that I am working hard to find employment and child support is all that I get right now, I manage my money accordingly. :)

My child support is not being used to fund this visa process. My fiance is covering all that. My child support goes to provide all the needs of my children, like shelter, food, clothing, school

supplies etc, just as it did before I got divorce.

None of my child support goes for frivolous things, but being that I am working hard to find employment and child support is all that I get right now, I manage my money accordingly. :)

:thumbs: maybe if i had kids.. i would be better at handling my money, :) :)

but i can't help but buy something i Walmart!! when i only need one thing but walkout with 5!

hope you get answer to you situation :) this visa stuff is never fun!

:rofl:Walmart is my second home my fiance says. I can usually find whatever I need there and the prices are't that bad.

And no, this visa stuff sucks, but I would go through it again for the man of my dreams. Can't wait till it's all over and we all can

be with the ones we love. (L)

You cannot use Child Support in the Affidavit of Support.

Why? Because technically & legally it simply isn't your money, it's the kids' money. While you can use other household members' income on the I-864 they must be of legal age (18) and obviously your children are not.
