I'm filing AOS and I'm using a Joint sponsor. She has everything complete except the recent paystubs. She is paid bi-weekly. Has paystubs for last month September, April and Fabruary. Would it be good enough along with 3 year Tax returns? I asked her to try to get employment letter, but seems like it might be too much of a hassle for her in such a huge company. I'm not sure what's right to do. Please advise. Thank you.

10/18/2011(day 0)- mailed AOS package to Chicago Lock box via USPS Express

10/19/2011(day 1)- packaged delivered

10/21/2011(day 3) - received email notification

10/24/2011(day 5)- Checks Cashed ($1490)

How many paystubs does she have for September? I would imagine that yes, it would be a problem if she doesn't have the paystubs AND cannot produce a letter from her employer attesting to her job. How else is USCIS to know she is still employed and making that money?

Sorry, she is gets paycheck 2/a month. And She has 2 paystubs for september. If USCIS needs to see that she is currently employed, wouldn't it be enough to show that she got paid in September as the MOST recent month?

I'm confused, it sounds like she DOES have her most recent paystubs if she has the stubs for September? After all, October only started a few days ago. Most people won't have paystubs for this month yet.

A letter of employment is not required to be submitted with the I-864 for USCIS can ask for it or send an RFE for it if they feel they need it so I'd include one.

Ah, gotcha. Well, I can only speak from personal experience, but when we went our application, I included my two most recent paystubs as well as a letter of employment (it didn't state my salary, just that I had a job and how long I'd had that job). We were never asked for anything else.

I guess the real question is, if need be, will she be able to procure a letter of employment and/or more paystubs? IE, if she gets an RFE for it, will she be able to get that evidence in time? If so, I'd go ahead with what you have based on my experience of 2 paystubs being enough. However, if you don't think she can get anything else in time to deal with a potential RFE, I'd wait until she has more paystubs to file so that on the off chance you do get an RFE, you don't get denied for not responding in sufficient time.

I have a joint sponsor who gets paid bi-monthly also. I submitted the 6 most recent paystubs for her(2 for each month) and an employment letter. It was accepted by USCIS and I got my EAD soon after.

I am just sharing my personal experience. when I filled my AOS at that time my spouse was not working so we get REF letter.

During that time spouse started working but we didn't had any paystub at that time so we just sent them employment letter.

After that, When we got our interview letter at that time they asked for employment letter as well as paystub for the sponsor and even during the interview they asked us about it. We just had our interview on Monday. waiting for decision. Hope it will helps.
