Hi Everyone,

Moved to USA in 2005 with my wife, at the time, and children. I arrived on L1, she on TN, and children on TD. In 2007 we divorced and I met my present wife, who is USC, in 2008. We got married in July and now in the process of filing the I-130/I-485. My children are still in USA with my ex-wife.

1. Do I need to file I-130 and/or I-485 for each child?

2. My L1 will expire at the end of the year. Can no longer renew, as I had for 7 years total. Should I fill out I-131 and I-765 with the I-485?

1. You do not file. Your wife may be able to file for your children if they were under age 18 when you got remarried. She would need to file separate I-130, I-485, and I-864 for each child. How old are the children now and how old were they when you got remarried?

2. Your wife needs to file an I-130 for you. In addition, you will need an I-485, G-325a, and I-864. The I-131 is optional and is a good idea if you intend to leave the US before completing your adjustment of status. The I-765 for an EAD is optional but necessary if you want to continue to work after your L1 expires.

My children are 10 and 12 years old. I did look at the "Guides", just wanted to confirm on the points that was not clear to me.
