Timeline

After calling and waiting I finally got a hold of a real person in Cairo about my Fiance Visa. I was so sad since they told me that they sent it back to USCIS in US September 19, 2011 citing that my fiance interviewed was not sufficient enough and the immigration officer suspect a fraud. He told me that the paperwork was sent for another checking if it is fraud or not. I understand their concern, but what are we going to do next. I received a letter today also from my Senator and I will still send them all the information to their office and I hope they can help us. I need all your help what is the next step to go after they have send back our paperwork.... :(:crying:

I'm sorry to hear this. Did you call before? I thought you called over 3 weeks ago and they emailed you about an interview. Maybe I misunderstood.

What did the Senator's letter say? Did you ask what exactly raised a red flag to make them believe your relationship was fraudulent? I suspect there's more to this than what your fiancee is telling you. Age difference alone is not reason enough for a denial.

How's your fiancee taking this? Is he willing to wait for this to be cleared up?

What did the Senator's letter say? Did you ask what exactly raised a red flag to make them believe your relationship was fraudulent? I suspect there's more to this than what your fiancee is telling you. Age difference alone is not reason enough for a denial.

He is being patient. I am hoping that we can have another interview but the person I spoken to that the paperwork was sent back to US for another verification and continue on what needed done. He told me that the they suspected fraud how can that be a fraud? It is crazy. I did ask them about what raised the red flag in the interview he said the officer was not convinced of his answer and suspected that he is only after the visa to migrate to US. The poor guy was so nervous when he was being interviewed. The way how it works in Cairo the interviewer sit in this room with a glass window and a microphone for a person to talk to them while the interview is being conducted. The first question is how did we meet and he told them the truth and the only way that triggerd his answer that made the consul made him uneasy is that the words that came out of his mouth is "Just Luck" evidently the interviewer did not like his answer and they called in for an interpreter for him he said that the interviewer was not even looking to him and very rude. I guess this is the way to break them down and make them tooo nervous to say anything right. I regret that I was not there for him for the interview. If we ever have the opportunity again I will never let him go by himself. Lesson learned....But we are hoping that the next interview will be easier for us. This is going to be a long haul. I have to reply to the Senator so they can go into my personal information and help me out the whole situation for us. They send me some paperwork to fill out for privacy act then i have to send them our story of what happened. I do not know if they can do anything about it now that our paperwork is sent back to USCIS....but I have to think positive and this is going to be a long haul for the both of us. I will visit him next year and wait for the USCIS to reply to us what we needed done...it maybe forever before they reply to us i was told that it takes time for them to respond any returned paperwork to USCIS. Tomorrow i will call them and see if they did received the paperwork since they mailed it on September 19, 2011. :(

i d say just go t egypt n marry him there. spouse visa is much stronger and file again that would take shorter time than to wait for reviewing ur case again.thats my opinion. good luck tho with whatever u do!!!

Wow! In the interest of 'keeping it real' I must say, 'just luck' is a terrible answer. I'd be insulted too, if I was the CO. It really comes across as he was not taking him/ her seriously. Sounds arrogant and sarcastic; far from nervous. However, the CO went overboard in his/ her reaction and now you're the one dealing with this rollercoaster. I don't think your mistake was you not being there. I think the mistake was not being prepared.

But, it looks like you're diligently working for a second chance. So, go through the questions again. Prepare him. Also, when was the last time you saw him? They take that into consideration too. Waiting a year to visit him won't help your case, I don't think.

i d say just go t egypt n marry him there. spouse visa is much stronger and file again that would take shorter time than to wait for reviewing ur case again.thats my opinion. good luck tho with whatever u do!!!

I don't necessarily believe this is entirely accurate. We've had cases where a spouse visa is denied or under a lengthy AP. Spouse visa is a longer process than a K-1 because the spouse will automatically get a GC upon arrival to the US. So it becomes more bureocratic than a fiancee visa.

That said, this is not bad advice. A lot of VJ'ers adviced her to marry him in Egypt, immediately following her fiancee interview. The hurdles of her case won't disappear, however. Right now, it's about overcoming the obstacles, getting prepared and re-submitting.

Don't ever do anything you're not willing to explain the paramedics.
