Hello. Please help me. My husband said to me just in case he changed his mind, he would go back to states. Therefore, he would file DCf in the future. But, is it really abolished in Manila?

And yet, I have so many questions.

1. My husband has been here in the Phils since March 2011 and we got married last april 2011. I did not yet apply him for permanent resident visa nor he still has no ACR-1. The one thing really sure is I always extend his visa as needed. Do we have to apply for permanent resident visa-13a before we file DCF? I still have to get my marriage certificate to do that because it is one of the requirements.

2. Another one is, he has no bank account here, no rental receipts because we are living with my parents, no bills under his name. What we need to do for us to collect those evidences just in case we will be filing for DCF? The good thing is we bought a big boat but it is under my name since we believe that foreigner cannot invest here.

3. Then, he has no place to go back to (USA). He stopped renting his apartment because he has intention to stay here longer. How does it affect the processing of DCF?

Thank you very much in advanced. I hope you can answer my queries. We are not intended to do the DCF right away but I do not want to have regrets in the future when we lack of documents.

You are ok. DCF is limited now, only USC living in countries where there is a USCIS office can file DCF. There is one in Manila, so your husband can still file for your spousal visa via DCF.

1. Not sure, hopefully some Philippines DCFers will chime in.

2. You need evidence of bonafide relationship- can you put some bills in joint names (maybe cell phone)? Can you add his name to your bank account? Get photos of your time together, one a month or so.

3. He needs to show he has not abandoned domicile in the USA or is intending to re-establish domicile. Does he still have any bills there? Did he maybe put his furniture in storage and can show receipts? Valid driving license, voter record? Evidence of looking for a job/ home for you for when he goes back?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hello. Thanks for your reply.

I will try to join his name on my account and to my monthly bills. There are no more bills because he terminated all contracts so he does not have to pay while he is in the Philippines. He has still driving license but the problem it will be expired this December. Maybe if we are ready to file for DCf, he will haunt for job and house to rent.

I hope I could get more replies for me to understand the process thoroughly.

my husband filed our petition here in Manila last January since he has ACR. im guessing it is one of the requirements needed in order to file thru DCF in Manila, that the petitioner has to prove that he has been residing in the Philippines. when we filed our petition, they asked fir his ACR.. but im not sure if that is the ONLY basis of residence right..

we also do not have bills under our names too. :) no rental receipts too.. what we have is a joint bank account which was 8months old when we asked for bank statement. plus the money that we had there was not really that much :) we submitted pictures of different occassions. plus our report of rating since we were classmates.

does he have other relatives in the US? he can say that he's staying with them just like my husband did.

i hope i helped you with your inquiries, and if you're wondering, my petition got approved 14 days after we filed our petition its just that they took so long looking for our address in batangas. when my husband inquired to the embassy last august regarding our petition, they said it was long overdue approved. so last september after our medical and interview, i got passed the visa interview :)
