Hi,

We are soon to get started on our immigration journey! We have been together for just over 3 1/2 years. We have been engaged since 4 days after we met!! She has 3 kids from her previous marriage (I treat them as my own, and I love them SO dearly). We now have a 9 1/2 month old baby boy together as well.

She is on the final steps to getting her annulment from her ex-husband. We are waiting for the final papers to be delivered to the NSO. Once that happens, we have one more hurdle to cross. Our oldest son has an error on his birth certificate. His mother's name is misspelled. In a classic Murphy's Law, we're waiting for the Laguna Municipal Office to be staffed with a permanent person before they can make that change. The previous permanent person passed away a few months back. From what we've been told, getting that birth certificate updated and processed in the NSO will take up to 2 months. So, we're working VERY hard to call the municipal office nearly every day asking if they're staffed.

So, I believe we have to wait until the birth certificate of our oldest son is corrected before we can submit any immigration paperwork. Does anyone here know if that is true?

After that last hurdle is crossed, then we will get flying on the immigration paperwork. Any advice anyone can give would be super helpful. Thanks SO much in advance.

11/13/2010-1/16/2011 -> Visited family for holidays in Manila. Our son was born!!

4/21/2011-9/7/2011 -> Visited family in Manila. Celebrated 3 year Anniversary of meeting!

12/2/2011-3/14/2012 -> Visited family again in Manila! Married in Laguna on 2/13/2012!!! Also, celebrated birthdays and holidays!

6/13/2012 -> Filed I-130s in support of CR-1 and 3 CR-2s (wife, 3 children)

6/18/2012 -> Priority Filing Date

6/20/2012 -> Received NOA1s

9/17/2012 -> Received NOA2s

10/1/2012 -> Received DS-3032s

10/4/2012 -> Paid I-864 AOS Fee

10/7/2012 -> Submitted DS-3032 emails

You believe wrong... no reason to wait for the corrected bc. It need only be correct at time of visa interview, some many months from now

She is on the final steps to getting her annulment from her ex-husband.

I say this is the one you should wait before filing. She is not considered legally free to marry until it's done. BC of the kid should be easier to fix than the annulment. It's long, it's tedious and it's costly. At times they're still denied.

Hi there!, As soon she gets Finality of her annulment from ex-husband then it is annotated in the previous Marriage Contract printed in Security Paper of NSO then you can already start filing for K-1 petition with supporting papers required for K-1 petition. You have to include a copy of her annotated marriage contract in your K-1 petition to show that she is legally free to marry. Then the kids names should be listed in the petition as well. The name of the child should already spelled correctly in the petition. However, while waiting for the approval of the K-1 petition which takes like 3-6 months (case-to-case), you have to work out on the mispelled birth certificate of the eldest son as this is needed during the interview together with all other requirements / evidences.
