Thank you to all my VJ'rs our there who helped me get married. After almost two years of marriage which included abuse on the part of my wife towards me, physical and verbal. My wife left approximately 2 1/2 months ago, her time period where they will take the conditions off of her permanent residency is coming up. Does anyone know if there is a way to report this since she is now running around with other men while we are still "legally" married and will not sign divorce papers which I think is just to prolong the process. I tried USCIS website, I called USCIS several times but no one has helped me. Has anyone heard of this situation. I want to report this so my soon to be ex cannot us me just to gain access to this great country of ours which she also claims to hate... Thanks.

And notify USCIS that you and her are no longer living together as a married couple.

Unless you get divorced she needs you to file for ROC. What ever you do NEVER be alone with her again, if she files a false claim of abuse then she can try to ROC without you. Her third option is to get divorced and file ROC without you.

As long as you are married and she can't claim abuse then she needs you to ROC, notifying USCIS that she has left you will cause her problems if she tries to file Jointly behind your back.

Thanks for all the replies so far. I have indeed contacted ICE, they forwarded me to USCIS. USCIS seems like it is just a phone bank, no one really knows what they are doing. They have a little information but they cant take a report from you. Would the local USCIS office be able to do anything? We are not living together and trying for the divorce I just cant get her to sign for obvious reasons, she can feel those papers really close. She will not be able to say I abused her or anything like that, she was the abuser I just wish now that I would of called the police on her at least one of the many times so I would have a report on file. She is the type of person that would do the AOC behind my back, that is why I want it reported. Thanks again and any more suggestions that may come up, I would love to hear them.

Yes, you need to write a letter to the USCIS office, you can make an infopass appointment and go to your local office and explain the situation. You need to write a good explanation so that its clearly documented as to what happened and create a timeline for the letter. You need to make it clear that you are withdrawing your i864 support and that you have no intentions of filing ROC and continuing to support her. You can go ahead and start the divorce proceedings if you haven't yet and use that paperwork as more evidence its clear you will no longer be married to her.

IT's very important at this time that you have NO contact with her ALONE! She can create other situations which she can then file false charges if you don't have someone with you to support your side of the story. You can also ask your divorce attorney about changing the locks and bank account info, don't do that without the attorneys approval.

If she texts you or emails you save everything from that. Print it out and keep it with your divorce papers/USCIS papers.

I'm sure that there is WAY more good info on what to do but you MUST go ahead and make an appt with the Local USCIS office to BE SURE THE INFO Is entered ASAP.

You need to make it clear that you are withdrawing your i864 support and that you have no intentions of filing ROC and continuing to support her.

Everything else was spot on but after a greencard is issued you can not withdraw your I-864 Affidavit of Support.

Apparently...

You file to Remove Conditions 2 years after the initial issuance of the Conditional Greencard. Once that first Greencard is issued the Petitioner CAN NOT withdraw their Affidavit of Support.

There is no need for an Affidavit of Support for Removal of Conditions because USCIS already has one (from the initial issuance of the Greencard).

All he can do is give USCIS written notice that his wife left him so they are no longer living as a couple and are planning to divorce.

Then if she attempts for falsely file a joint petition (which would require she forge his signature) then she can be charged with Material Misrepresentation which would lead to denial and deportation.

don't take me wrong, but it does sounds like a sore attempt to get revenge. Unless you have absolute proof that she "abused you", then get over it and forget about revenge.

Thank you for all the replies, has given me some more ideas. Nothing about this is about revenge or anything, I always knew that it was a possiblity because there are bad people in this world. I just want to protect myself, no I never reported the abuse so no I cannot PROVE it. My mistake there but I loved her and did not want to send her to jail... I'll just keep talking with my lawyer handling the divorce and see if he comes up with anything else as well. It sounds like everyone is saying she has to have me to remove the condition and there is no way I will sign the paper so the only way is a forgery, so I will make sure and make an appointment.

I would take JimVaPhuong's advice and hold off on the divorce until her 2 year green card expires. As he said, if she is still married, she will not be able to easily remove conditions on her own.

Why can't she claim you abused her? You think that people like this are always honest? Even without real proof, some people are such gifted con artists that they DO manage to convince police officers and even judges of such things regardless of whether such events actually occurred. And maybe she would have made such a claim against you if you had ever called the police on her. I have heard of such cases where the one making the call is the one that winds up in hand-cuffs and with an arrest record! The fact that she has not yet done this is to your great advantage! DO change your locks and DON'T be alone with her anywhere! Make your reports at an infopass appt. and then move on with your life. Brooding and hating does not hurt the person it is directed against. It hurts the person doing it. Good Luck!
