completely confused on how to fill out "PART 3", "PART 5" & "PART 7 question 28" (on the I-864 form)

the AOS is for my Russian wife and 11 yr old Son.

we are using a co-sponsor (which is where some of my confussion on how to fill out these sections)

"PART 3"

I assume I need check box 8 and the box YES and also check box 9 then list my wife's 11 yr old son in the underneath section OR do we not check BOX 9 and do not list the son because he will have a seperate I-864 filed at the same time as his wife by me (sponsor) and co-sponsor?

(I am assuming I need fill this section out the same for both me (sponsor) and the "co-sponsor")

now also in this section does our 11 yr old have an "Alien Number"?

the only Alien Number I know of is the one for my wife, so I am not sure if our son has an alien number or I use the same number for him as for my wife?

"PART 5"

on this part the questions have to do with "How to fill this out for the co-sponsor"

for the co-sponsor on 21a do we put 2 (my wife and son), OR 1 (only wife because we do not list the son in PART 3 because he will have his own seperate I-864 filled by me and the co-sponsor) OR 0 (zero) because this neither live with the co-sponsor???

"PART 7"

Question 28 -ASSETS of PRINCIPAL SPONSOR IMMIGRANT

my wife's name is on both our checking and savings accounts do I list these as "assets" for her even though they would be listed on the above "Question 26" for ASSETS of SPONSOR?

and on the "CO-SPONORS" I-864 are these assets list on Question 28 or left blank since these assests are accounted for in the "Sponsor Assets" on the I-864 I will be filling?

any and all help will be appreciated

Re-read the instructions for the 485 and the 864. Since he is a K-2, you merely do one 864 form for her (listing him in the appropriate sections) and then just include a copy of her 864 form in his 485 package. You also, I believe, do not have to recopy the finanical documents accompanying her 864.

Re-read the instructions. I recollect these facts (meaning I admit to being corrected by others if I got something wrong!)

Re-read the instructions for the 485 and the 864. Since he is a K-2, you merely do one 864 form for her (listing him in the appropriate sections) and then just include a copy of her 864 form in his 485 package. You also, I believe, do not have to recopy the finanical documents accompanying her 864.

the way I read it I would still need to fill out "2" I-864 forms

one I fill out myself as the "Sponsor"

and one that must be filled out by the "Co-sponsor"

so if I have understood the instructions correct I still have basiclly the same questions as above

If the child entered on his mother's passport, then he won't have an Alien number, but if the child has his own passport, you should be able to find the alien number.

he has his own passport with his own I-94 card stapled to it. The only Alien Number I can find is the one listed on the I797C NOA for his mother. They entered at the same time and on the child's K2 visa inside his passport it states under the "WAC" number --- P/A (then mother's name)

where on his mother's K1 Visa under the (same) "WAC" number ---- PETITIONER (then my name)

on the NOA it only lists the mother's name in the "Beneficiary" with her Alien number

on the NOA it only lists the mother's name in the "Beneficiary" with her Alien number

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes to box 8, yes to box 9 and list your son's name and info on line 9a. Yes, will the same for the cosponsor's form.

If he wasn't assigned any on the I-94, then list None since that is the truth. Your wife's number is only hers.

Don't list them on the cosponsors....they are of little use since you're using a cosponsor, who soley must provide the income to show that they can support the entire household plus themselves.

21a will have 2, your wife and son, carried from Part 3, 21 a will have a 1 for the cosponsor, 21e will have 1 for you, since the cosponsor must support the entire household which you are part of.

Since for your son's application all you need is a complete copy of your wife's 864s (both forms), all the info will be the same.
