Tax return forms for K1 interview (W2 or 1040?)

I forgot to mention that the question is for Romanians who already had their K1 interview. I am Romanian and will go for the K1 interview at the American Consulate in Bucharest.

Hello!

I have a question for those of you who had the K1 interview. It's about my boyfriend's tax return form(s) that I have to bring at the K1 interview (with the I 134). Is the W2 enough or does he have to sent me the last 1040? Or both? And how can he notarize the 1040 if the original was sent to the IRS? We are still trying to figure this out. He has his W2 from 2009 and 2010 but no 1040. Not sure yet how to get it.

One more question: should he notarize the I-134 form?

You can contact the IRS and ask them for the tax transcripts for those two years. I went to the website and downloaded an auth. form and signed and faxed it back....and i received a shortened version of 1040 tax returns for the last 5 years. Each year was only 1 page long. It did take about two weeks to received. You may be able to do it online, I had to fax it because I moved since my last 2010 filing. Hope this helps. Go to the IRS.gov website

He can send either a complete copy of the tax return he sent to the IRS or a transcript of the tax return from the IRS. If he decides to send a copy of the tax return then it should contain a copy of every document sent to the IRS, including 1040 form, W2's, etc. If he decides to send IRS transcripts then nothing else is needed. A tax return transcript from the IRS is better - it proves a tax return was actually filed with the IRS, and shows the numbers that were recorded by the IRS when the tax return was filed. Make sure he gets a tax return transcript and not a tax account transcript. A tax account transcript doesn't show "total income" from the tax return, which is what the consulate will be looking at.

Most consulates don't require the tax return copy to be notarized, nor do they require the I-134 to be notarized.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
