Wrong Middle Name On Petition

My middle name is wrong on Petition been trying to have it changed. I called NVC today but they've sent it to Consulate in London today. They said to contact them and said shouldn't be a problem if they have birth certificate and passport. My question is has anybody had this happened to them?

How wrong is "wrong"? if it's a typo that's one thing, if its a completely different name i doubt that looks good that the USC doesn't know the fiance's middle name... It's likely the information will still be wrong on the visa stuff... What does the NOA1 say? Make sure he calls to "fix" it over the system, probably make an infopass and then make sure he checks the NOA2 when you get it

I had an attorney file my petition and they were the ones that did the mistake. My first and last name are correct except middle name. I first noticed when the USCIS sent me an RFE. I called them and they said to make sure when I sent the things they we're requesting to make a note along with the things. I made sure the attorney knew about it and said they would sent a note and a copy of my birth certificate again along with the evidence. Just got the approval few days ago and noticed again that they still had my middle name wrong but said on approval that they had sent file to NVC already. So today I called NVC to let them know about it, but they said file had been sent to London today. They said to call Consulate in London in few days give it time to arrive. :unsure:

I wouldn't recommend doing that because:

  1. It will cost you $16 for them to answer the phone and talk to you for up to 7 minutes.
  2. London won't even acknowledge your case is there for maybe 3 weeks.
  3. The person on the phone won't be able to sort it out.

If you're the USC, it won't be as critical because your name isn't going on a visa, into immigration databases at POE, or on a greencard. I'd have my fiance discuss it in person at the interview. Send him a copy of your birth certificate for that purpose. The embassy isn't USCIS so I don't think they can change USCIS records or issue you a corrected NOA2 if that's what you want. Take that up again with USCIS or make your lawyer get a corrected NOA2. They should fix the mess to your satisfaction since it was their mistake.

Meanwhile contine to fill out forms with the correct name. Your fiance will do forms for London.

And fire the lawyer. They got your name wrong and you got an RFE. Not a good track record.

Completely agree. When you use a lawyer you shouldn't get an RFE, they're "supposed" to be experts... let alone getting your name wrong.. sheesh.
