When will I know if I need a co-sponsor?

This may be an obvious question but I haven't found out any information about it.

How and when will the petitioner find out if they need to have a co-sponsor?

I just got a full-time permanent job (the first one since I graduated college) and my income is well over the 125% requirement for 2 household members. However, I am a little worried that I will not qualify to sponsor my fiance myself because I was so recently hired. Also my past job history shows me jumping from temporary seasonal job to temp seasonal job for the past 2 years. I hope that they factor in the fact that I only graduated from college in 2009 and thus the temp jobs were a stepping stone and transitional period to where I am now.

That being said, when will my fiance and I find out if we need to have a co-sponsor? Is it after the I-129F is filed and approved? Will we get a notice with packet 3?

Regardless, my mom agreed to be my co-sponsor but of course I would rather do it myself.

no need to wait, you don't qualify and you will need a joint sponsor, if you didn't meet the poverty guidelines for 2010 taxes, then you will need a joint sponsor. if last year you didn't make over 18 thousand, then you need a joint sponsor.

you can start looking for one now.

Can you point me to where specifically you got this information? When reading the I-134 instructions, I understood that submitting a letter from your employer with your salary, job title, etc would be sufficient evidence to prove that your fiance will not become a public charge when they enter the US. My best advice to you is to get a co-sponsor now just in case. At the time of the interview they may deny the visa say you don't meet the income requirements, that is how you will find out. If you make the money now and show plenty of proof like paystubs and a letter from your employer they may just let you sponsor, but the thing is, you don't want to get all the way to the interview and find out that the denied the visa because they do not feel comfortable with the fact that this income has lasted less than a year. It is better to play it safe and since your mom has agreed then have her fill out the paper work. If a co-sponsor is not needed, they will not use her information.

Uhmm.. at your fiance's interview when they deny the visa if one was needed. No one is going to come out and tell you whether you need one or not. It is up to the CO doing the interview. You can make over the minimum threshold for the last 3 years and he can still deny the visa if he wants. It's the CO's discretion, meaning... if you don't meet the minimum, the visa will be denied. If you do meet the minimum, while the visa should not be denied, it is his discretion to deny it if he so chooses.

So the answer to your question is... "At the interview and the visa will be denied if a co-sponsor was needed (in his opinion) and your fiance did not bring an I-864 signed by a co-sponsor to the interview."

That being said, when will my fiance and I find out if we need to have a co-sponsor?

So the answer to your question is... "At the interview and the visa will be denied if a co-sponsor was needed (in his opinion) and your fiance did not bring an I-864 signed by a co-sponsor to the interview."

It would actually be the I-134 in the case of fiance. I-864 is used for spouses.

I am in the same exact boat!I graduated college in May 2011 and now have a full time career making over 35K -but I do not have past tax statements showing 125% poverty level because I was also working odd jobs for summer and semesters etc...

I read a couple months ago in another VJ forum that some people were approved the K1 by ONLY showing a letter from employer and months of pay stubs! After reading this, my fiance put together "Plan A" interview packet, and "Plan B" interview packet. Plan A only includes a letter from my employer and about 6 pay stubs. Plan B has that, plus 2009, 2010 tax statements, even though they only shoe about $4,000 each, plus a letter explaining that I just graduated, and moved across the country right after graduation for my dream career with a solid company!

After reading this, I'm thinking that maybe we should come up with "Plan C" -which includes all of the above plus my parents as sponsor! Getting a sponsor was our original plan.... but since I got this job (even before I graduated!) we were determined to do it on our own. If Johan shows up at his interview with 3 packets, will that look really suspicious? We want to keep things as simple as possible, and try to avoid involving sponsors.

We are actually filing for an extension right now (extending the date he can have his interview), so Johan can finish a work contract before moving here... so getting denied after ALL this time would be devastating!

So I guess my questions are:

Will a letter from employer and pay stubs not be enough for a recent graduate?

Will having 3 packets (obviously he would not present them all at the same time) raise a red flag?

They will tell you at the interview and if you do not have one then your visa is delayed and you have to come back with one. It is YOUR job to decide now and prepare for it and have the co-sponsor papers with you at the interview and present them with your evidence.

If your income at the time of the interview is above the guidelines you do not need a co-sponsor.

Why would you have to qualify for THIS year, LAST year? If you do not know, then say so. Inaccurate answers do not help.

People qualify every day with current income verification. Last years taxes are not even required for a K-1 unless you are self employed OR the consulate specifies it.

If your mom already agreed, I would recommend using her. Many embassies would probably let you slide because it's supposed to be based on what they think you will be able to provide ongoing, not in the past. The Indian embassies, however, have been known to use whatever little thing is at their disposal as a basis of denial or at least a 221g.

You've already got some hurdles to overcome if RCG, Team Erra, SherryYasphal and Dipu and I (among many others, I'm sure) are any indication. DON'T voluntarily give them ammunition.

For the K-1 visa you will have to supply the I-134 but since there are no specific requirements for income it is generally (I think most consulates) based on the I-864 that has to be filed for AOS.To qualify as a sponsor, you must demonstrate that your income is at least 125 percent of the current Federal poverty guideline for your household size. The Federal poverty line, for purposes of this form, is updated annually and can be found on Form I-864P, Poverty Guidelines.

I do not recall seeing anything saying that you have to have had the job for a certain amount of time. You need an amount for an annual income to qualify. Just the same, the question about job consistency may arise at the interview, and if you can get a co-sponsor that information can be offered if your I-134 is not enough.

Unless things have changed since we did this, showing current employment with letter, stubs etc should suffice.

My husband was unemployed for 8 months before he got a job the week after our NOA 2. We therefore only had 3 months worth of paystubs and a letter from his employer to prove that we met minimum requirements.

Line up the co-sponsor just incase.

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)
