I-751 October 2011 Filers

Thank you for listing this information. We have been away from Visa Journey for some time and now it is time for us to also file for the removal of conditions. I looked that the USCIS site and it did not say anything about sending proof but I was thinking that would be very strange as they want proof if you "pass gas". As with your question I am looking for some kind of confrmation on this list and maybe a "sample" of the affidavits. Not sure I can come up with the lease with both our names on it, I rent my house from the bank (mortage). We do have some photos of us together with friends and such but I am sure we can get some new ones before we send it off.

Any other advice on this part of the process would be helpful.

Hi Guys,

Just want to get y'all input if we did provide enough evidence.. these are the ones we turned in

• Copies of the passport and green card of immigrant wife
  
• TWO sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.
• Copy of the JOINT Income tax returns for 2010 both Federal and State.
• JOINT 2 yr lease agreement with the landlord.
• Copy of JOINT Credit Card account stating IMMIGRANT WIFE as an authorized user of the Card from CHASE BANK
• COPY of CARD for Health, Dental, Pharmacy Insurance from Gilsbar Health and Vision Insurance (Note the card showing EMP + 1) under the same policy.
• Pictures together, with friends, and family.
• Copy of Card address to me and my wife.

Thank you for the link. I thought I was told that we had to wait to apply for the ROC when we had 9 months left before the expiration but no later then 90 day before the expiration. Everything I read on the link said to wait until there was 90 days left before the expiration. Am I reading this worng? I also noticed that it said you MUST file 90 days before the expiration. Also has anyone here not been able to provide a mortgage with both names on it. I would have had to refinance my house to make that happen and that is just not possiable. Getting all the other documents will not be an issue though.

There is an example in the guides for an affidavit from a friend. We used that example. We just changed the names of course.

You have to apply WITHIN 90 days BEFORE your GC expires. We actually got a letter in July reminding us to do so before my husband's GC expires on 11/18 but I have read that not all people receive such a letter. Our window to file was after 8/20 but before 11/18.

We had a similar situation with our house: the mortgage is only in my name, so I sent a copy of the mortgage account info showing it was in my maiden name and explained in the cover letter that I began the purchase process on the home before we were married and it was finalized while my husband was a recent immigrant and did not yet have a SS# or any established credit, and that is why we didn't have any lease/mortgage together. I can't guarantee that this will work as we have not yet been "approved" but I don't foresee any problem. We had 2 affidavits & lots of other financial ties together.

I was tracking mine too and it was saying it was still in the postal office I sent it from on the day it was supposed to be delivered and the status only changed in the afternoon when the package is already delivered. I guess, they don't update the status until the package reaches the destination.

I am not sure about the mortgage not having both of your names or even a lease but I guess an explanation letter could be included in your application regarding the situation. And as this type of document is to show that you are living together, you can add Driver's License or State IDs that show that you and your wife are in the same address or any other official documents that can show you live in the same address.

We embarked on the I-751 "removal of conditions" journey earlier this month via Vermont.

Here is our current status:

10/11/2011 - Mailed I-751 package (USPS Priority Mail with electronic return receipt)

10/13/2011 - VSC signed for package

10/18/2011 - Check cashed

We included the following supporting documentation with our I-751:

Signed cover letter

Three original sworn statements written by U.S. citizen friends and co-workers

List of addresses (2) since immigrating to the United States

Copies of jointly-filed federal and state tax forms

Copy of lease for rental house

Copy of promissory note, in both names, for renovation loan for primary residence

Copy of HUD-1 settlement statement, in both names, for mortgage financing of primary residence

Copy of warranty deed, in both names, for primary residence

Copy of mortgage company statement, in both names, for primary residence

Proof of fire insurance on primary residence in both names

Copy of car title in both names

Proof of auto insurance listing in both names

Copies of health insurance cards

Copy of notarized form specifying spouse as 401K beneficiary

Joint checking account bank statements from February 2010 and September 2011

Joint savings account bank statement from January 2010

Joint credit card account bank statements from February 2010 and September 2011

Joint checking account bank statement (another bank) from December 2010

Copies of electricity bills for primary residence

Copies of gas, water, sewage, trash bills for primary residence
