QUESTION IN REGARDS TO IR-1/CR-1

HI

I RECENTLY SUBMITTED MY 1-130 TOGETHER WITH MY G-325/G-325A. BUT I STILL A LITTLE BIT CONFUSE IN REGARDS TO THE FORMS AND TIME ITS GOING TO TAKE?

OK SO I-130 IS OUT OK, SO MY QUESTION IS WHATS THE NEXT FORM I HAVE TO SUBMIT OR WHATS THE NEXT STEP?

DOES ANYONE KNOWS ALL THE FORMS IM GOING TO HAVE TO FILE ?

ALSO I BEEN IN THE UNITED STATES FOR 13 YEARS NOW AND I WAS TOLD I'M GOING TO HAVE TO EXIT THE UNITED STATES FOR MY APPOINTMENT IN MEXICO CITY, SINCE I DIDNT WANT TO GO TO CIUDAD JUAREZ SO DOES ANYONE KNOWS HOW LONG THEY MAY MAKE ME STAY IN MEXICO?

OR WHAT ELSE I MAY NEED TO FILE SINCE I CAME HERE ILLEGALY?

who is filing for you your USC spouse? If so, sorry you can't choose which consulate you will have your interview. You cannot have it in Mexico City, the only place is Juarez.

it all will depend on the waiver and hardship letter that you spouse will have to present. it can be from months to over a year.

only to Juarez, the only type of petition that has their interview in Mexico City is siblings petition. they changed it from Juarez to Cd de Mexico last year. but all the rest of petitions still go to Juarez..

you can check the guides. once the i130 is approved, they will send it to the NVC or National Visa Center, where you will get your case number. then they will requests more payments and forms until your file is complete. you will get later your interview letter.

OMG I CANT BELIEVE THAT ! JUST THINKING ABOUT GOING TO CIUDAD JUAREZ SCARES ME SPECIALLY WITH ALL THE VIOLENCE IN MEXICO . I GUESS THERES NO OTHER WAY .

hello,

Well after the I30 and the other one you mentioned you still have to file more. Such as Affidavit of support I-864 and the DS-260. I am not sure if there were any others.. Also Juarez is the only consulate which handles Immigrant visas in Mexico. Which means that you will have to go to Juarez. But dont be like me. Read reviews here on this same website and you will learn that Juarez isnt that bad after all or at least where the consulate and all those things are at. Its a good and secure area.

Thanks Gabriella. So that means that you also went to ciudad Juarez for your appointment? If you did how long did you stay there and if you don't mind me asking did you came to the states illegally or legal?

Am I missing something and misunderstanding the bolded statement that you came to the US illegally??

yes i came here illegally when i was small i been here for 13 years now but i am marry to a citizen!

We can't really answer any of the really important questions unless we know your entire immigration history, and even when you tell us, you will find much more help and support at www.immigrate2us.net. I suggest you go over there immediately--they are absolute experts in your type of case--you will get support here, but there you will get solutions.

Thanks for clarifying. Sounds to be more complicated than just being able to fill out forms since you were here illegally. But I will let the more experienced VJers answer :unsure:

The illegal entry is why she MUST return to Mexico for Consular Processing. Since she never had legal status in the US she can't adjust status in country.

Once she leaves she will incur re-entry bans for her illegal presence (based on time in the US since 6 months after her 18th birthday.

She'll be denied at the IV Interview and need to submit a a Hardship Waiver immediately. If approved the waiver will allow her Visa to be approved.

Now if she's used false documents or claimed to be a US Citizen to work (filled out an I-9 Form) then her problems just got a whole lot worse.
