Hi everyone,

I received an E-mail saying that our case was deemed ineligible per "221g". What can I do about this? Is there anyway to avoid the case being sent back to the USCIS, they took 9 months last time. We have made it this far, and sent in everything they have requested plus more, I don't understand why this happens.

We would need more information to answer you. What was the 221g for?

You didnt provide them with enough documents to be eligible for the visa!!!!!

We did though. USCIS accepted the case, NVC accepted the case, and the officer at the embassy accepted our case, he just requested that we sent in an I-864 with 1040 and W-2 before they sent the visa out. He told us the case was accepted.

Did you pay taxes in 2010?? Also, do you make enough to support your wife or husband???

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

OK so have you sent in the documentation they want? If so, what did they say? If not, why not? The case will only be sent back if you do not reply in the appropriate time (usually 30 or 60 days) and submit the documents.

Yes we have sent in all the documentation they requested, USCIS, NVC, and at the embassy. We went to the embassy and after the second interview we were given a blue 221g form, requesting my I-864, which we sent in, and I received written confirmation the embassy received it. This was the only document that they requested, and it was filled out properly, met the guidelines, and sent in on time. For this reason the whole situation is a mistake, because I sent in the only document they were requesting (on the blue 221g).

I`m looking for answers along the lines on how to battle against the 221g process, especially when it is in error. I can assure everyone all the documentation meets the requirements and was sent in on tim, etc.,etc.
