Greetings - Is there someone who can explain how the priority dates actually work? I have been reading as much as I can find on the topic but am really stumped. For instance, my Father-In_Law petitoned to have his three remaining unmarried adult children immigrate to the USA. This was in 2003. We have a priority date of October 14, 2003. When I checked the VISA bulleten for October 2011 it shows a date of 15JUL03 for the F2B catagory for China. But when I looked at VISA bulletens for 2010 the priority dates listed were, for example, 01JUL05. If the priority dates for F2B were indeed for 2005 back in 2010 then why wouldn't my Father-In-Laws three adult children have received a VISA since thier priority date was prior to 01JUN05?

This whole priority dates mechanism is very confusing. Also, between the time my Father-In-Law petitioned the government to have his remaining three adult children immigrate to the USA back in 2003, he has become a US Citizen. WOuld that make a difference in the priority dates for his original petition? ANd idf so would anybody know how we should proceed to inform the government the change in my Father-In-Law's status?

There is only a limited number of visas available each year for FB petitions. At the beginning of this year there was a retrogression, this means that the PD moved backwards, that is why you saw 2005 las year and 2003 this year.

Now that he is a USC he can upgrade the petitions to FB1 and their priority date should be current. The PD for FB1 is in 2004 already.

PD: 30 DEC 2008

CC: 12 DEC 2010

Interview: 04 OCT 2011: Approved

POE: 15 OCT 2011 JFK

Your father in law should contact the NVC to upgrade these cases. He needs to provide proof of US citizenship in order for the NVC to move these cases to the F-1 family preference category. The current PD for F-1 is June 15, 2004. This means these cases would be current and they beneficiaries can apply for visas.
