Hi guys,

I am currently here in Houston Tx under K1 visa. I have 2 kids left in the Philippines and they do not have passport yet.Me and my husband wants to get them here in the next few months. I want to know if any of you guys here know how will my kids apply for passport without my appearance since it says on DFA website one of the requirements for applying for passport for minors is appearance of either parents. I am very much hoping for your help and advice. Thanks everyone and God bless you all!

Your fiance didn't apply for K-2 instead of K-1? You will need a consent from the father/s too to allow his kid fly out of the country.

If your fiance applied for K-2, your kids should have been with you now. But either or, it needs a consent from a father. If it requires the presence of either parent, then make him do the work.

Hi Ms. Jeanb84,

Question for you. Did you petition your children and receive K2 visas for them? Did you indicate they will "follow to join"? I don't think you did because If you did, they would have had to have passports when you purchased the visas. They went with you on the interview? They can attend a later interview with a designated guardian though. I'm assuming you did not petition them. If you did not, I don't think they will be there in the next few months. Now you will have to petition them and start the whole process.

You can get them passports with a "special power of attorney" according to the DFA website.

BTW, if there is no father listed on their BC and they have your maiden name, then don't worry about the bio father...his consent is not needed for them to leave the country.

I should have asked did your Fiance petition your children along with you. You could not petition your children when he petitioned you, he would have done this.

K2 are allowed to follow after the K1 holder's entry to the states. They should be able to finish the whole k2 process w/n one year as stated in the eligibility letter. and yes it needs the present of either parent plus consent to travel from the other parent.

I came here on a K1 visa and later my hubby petitioned my 2 kids thru I-130. My kids were able to get their passport with out me.It was my mom who accompanied my minor kids in getting their passports but still u have to go through a lot of documentation and such.

You hav to have authenticated documents from here to be sent to whoever is applying for the passport.
