how can i bring my child here in the US? Help!

I have a pending AOS. And I wanna bring my child here in the US. She is back in my country. My USC husband is not her biological father. How can we bring her here while my AOS is pending? We just filed at the beggining of this month. Can we also file a petition for her?

How old is she and what is her maritial status ?

She is only 5

Assuming you are AOSing because you came on a K1 and it has been less than a year you can submit a K2 follow to join petition.

No. I am not on K1. I was out of status when I married my USC husband. He filed I-130 for me and AOS too which are all pending right now. Can he file an I-130 for her?

Yes he became the stepfather before she turned 18 so he can petition. Just like he did for you .

He can file it anytime? Even if he just filed one for me? Or should we wait til I get mine approved? I wanna get her as soon as possible
