hi there me and my husband are getting ready to send out i130 i485 together however we have a question about form i864.

My sister and her husband are our joint sponsors. I was told that my husband who is petitioning for me haas to fill out the form as well. Im just a bit confused on who fills what out.

This is what we have:

sister fillled out i864 as fisrt joint sponsor

brother in las filled out i864 as second joint sponsor.

then of course my husband has to fill it out. but my concern is he barely started his own buisness earlier this month so we have yet to see the kind of money he will make.

this is his first real job so he has never before filed tax return so we dont have a copy of transcripts (we are both 19 years old) therefor we do not have his income...thats kind of the whole reason why we have joint sponsors.....soooooo what do we do?? just fill out the i864 and leave those spots blank?? is that ok?

THANKS FOR ANY HELP

Put his current income now, and for the past years put zero. Just fill out the form :)

The sister in law needs a I-864A.

Ok. Sorry to be such a pain in the rear :(

I really appreciate your help.

But like I said last time... she makes more money then he does thats why we were putting her as i-864 (1st of two Joint Sponsors) and i asked weather he also had to fill out this form since it gives an option to fill out the form as the 2nd of two sponsors)

If you read the instructions at uscis.gov, it says that the "second joint sponsor" can only be used in the case of a large family immigrating, and one person sponsoring part of the family and another person sponsoring the rest of the family. Look at the instructions on page 3, "What is a joint sponsor?"

If the sister-in-law makes more than the brother, then you can switch it and she can fill out a I-864 and the brother can fill in I-864A.

Husband still needs I-864.

I take it the sister and her husband share the same household. Therefor you need to file only one i-864 and supplement it with the i-864A... you will only have 1 joint sponsor.

Use option: "d. I am the only joint sponsor" for your sister-in-law

Your husband needs to file his own i-864 since he's the petitioner (doesn't matter how much he makes).

Use option: "a. I am the petitioner. I filed or am filing for the immigration of my relative" for you husband
