I highly doubt American Taxpayers are wanting to pay for the immigration of your future spouse and their child nor would I expect them to.

11/18/08 - Arrived in U.S. on B2 visa

02/05/09 - Extended return plane ticket to stay for an extra 3 months

04/23/09 - Decided we didn't want to be apart even though we extended the stay and got married!

04/30/09 - Sent I-130/I-485/I-765 from B2 (no I-693 as it is not yet complete.)

05/03/09 - Received email form USPS stating that package had arrived safely and was signed for!

05/11/09 - Received NOA1's for I-130/I-485/I-765

05/16/09 - Received Biometrics Appointment

05/30/09 - Received a CRAZY amount of RFE's that were dated 05/21/09

06/01/09 - Biometrics Appointment Scheduled. In and out in 10 minutes!! Sent off RFE information (Should arrive in MO on Wed.)

06/03/09 - USCIS received RFE response

07/23/09 - I called to have a service request put in

07/24/09 - I-765 Touched (FINALLY)

07/25/09 - I-765 CARD PRODUCTION ORDERED!!!!!!!! (About time!)

08/03/09 - EAD card came in the mail WOOHOO!!!

08/07/09 - Interview letter arrived

09/02/09 - Interview Date

09/07/09 - I think this is the day I received my Green Card.. Can't quite remember anymore.

Removal Of Conditions

08/03/11 - WOW it's already been TWO years! Sent ROC package to VSC.

08/05/11 - NOA1 date which arrived 8/10/2011

09/02/11 - Bio Appointment the notice was dated 8/12/11

No write-offs but you can claim them as dependents and change your filing status to married if you do that before Dec 31.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

Based on the math done by my accountant I am going to go from filing single to married and from just me to four of us. Apparently while I get a tax deduction for all four of us I also get a tax credit for the minors, something like $3,000 or $3,500 each. My take home pay will increase about $1,000 a month as a result.

I am not doing this for the money! That's the way the tax code works. I have been claiming Single Zero for 30 years and paying a boatload of bucks.

You'd think monies that you pay the government would not be taxable. Do you pay a tax on traffic tickets? A tax on parking Meters? A tax on VA income? Nope.

Actually you do pay tax on the money you use to pay for traffic tickets and parking meters.

Not sure why you included VA Income with two expenses.

Why would money paid as fines (traffic tickets) or for a service (parking or Immigration) be tax deductible?

You pay taxes on parking meters? Our taxes went down 1/4% here and I still pay 50 cents for 2 hours.

VA income is not taxable.

There used to be a time when LOTS of stuff was deductible, even interest on credit cards! Ah the good old days.

You don't pay tax on the meters per-say but you don't get to deduct what you put in hence you've paid taxes on the money already.

Yeah, so VA income isn't taxable, my question was why did you include it with Traffic Fines and Parking Meter fees which are expenses not income?

Both expenses and income can be taxable or non-taxable. There is no consistency.

Yes.

This has nothing to do with "paying for immigration" If you get married before midnight on December 31, 2011 your status will be "married filing joint" and if you have a qualifying child, YES you get the child tax credit, There are some qualifications to this, so check with your tax professional.

If the child does not qualify this year, they will next year.

When you get married and you have children you become a family just like any other family and are entitled to the same credits as anyone else. To suggest that "taxpayers are paying for your immigration" is simply ignorance of the tax laws.

Anh, the child tax credit he refers to has nothing to do with fees and expenses. Every family gets a child tax credit of $1000 for each qualifying child. We get $2000 in tax credits on top of everything else. This is in addition to the standard deduction or itemized deductions. We also get education credits worth thousands of dollars and the goverment recently extended the limits on those to "lifetime". Between Alla's 50% scholarship and the $2600 tax credit we got every year (including for 2011 as she just grqaduated in June) her education was "almost free". I have to remind her of this when she gripes about how expensive education is here.

Why should taxpayers pay for it? Because education is cheaper than welfare and we now have another teacher certified to teach English to immigrants and help our community in general.

This is correct. The tax advantages of going from single to married with children AND having students in college are incredible. You will see! Our tax return every year easily covers our twice annual trips to Ukraine. Once they back the truck up to our bank and dump all the money in our account, we buy our tickets for the year. :P Or you can choose to reduce your witholding to about -0- and have the extra monthly income. Your choice. Given the paltry interest rates banks pay, I prefer just to let Uncle Sam hold it for me.

sorry but I need to correct you he is an American Taxpayer who is already contributing towards the 2 Billion Dollar a year USCIS budget and paying fees also, so to be able to recoup some money back, yes back form the clutches of our bloated federal government via any write-offs or deductions are a good thing.

Simple answer is no you can not deduct any of the fees, expenses or incurred costs for the immigration process for your wife and future child. If you were adopting the child then you can deduct some of the expenses for this, but in your case you are sponsoring the child for immigration so bottom line is no you can't.
