i-130 intent to revoke

Timeline

I received a letter stating intent to revoke my case. I've been waiting for this the last 5 months :)

I have a lot of proof that im going to send :

-over 1000 texts between us

-pictures

-proof i've sent him money (western union)

-proof i've mailed him gifts

-letters from friends and family

-emails

My question is:

How long does it take for them to review this?

How long it takes?

What will the next step be?

You must give us more info in the letter of intend to revoke

All we can say is that you are talking about a CR Visa and No A K Visa

The notification must tell you the reasons for the intent.

sorry, the link on this post is the previous post regarding this case.

The visa was denied because they think is a "fake" marriage. So they are asking for evidence to not close the case

In the letter it states 5 reasons the officer thinks our marriage is not real.

Like i said our officer at the US Embassy asked very unorthodox questions, and our answers were not similar.

You said in your other thread that you visit him every few months. Do you have any evidence to back this up? Proof of "face time" is always much better than emails or text messages. Also, is it possible to get some sworn affidavits from friends and family testifying to the validity of the relationship?

You really need to be thinking about bombarding them with everything you've got. Don't hold back thinking you'll get an RFE or another chance to submit evidence. You only get one shot at convincing them not to revoke the petition approval. Even worse, if the petition approval is revoked and if there's a P6C marker in the case file (which is likely) then revoking the approval would be equivalent to finding your husband guilty of immigration fraud. You'd need to get an I-601 hardship waiver approved before he could get a visa. When the consulate denied the visa because they suspected the marriage was a sham they effectively accused your husband of fraud. If USCIS revokes the approval of the petition then they've concurred with this accusation - your husband would be guilty of fraud.

You were advised in your other thread to begin preparing for a response to the Notice Of Intent as soon as you found out the visa was denied. Hopefully, you followed that advice, did your research, and have your evidence ready. You weren't prepared for the interview. It would be tragic if you also weren't prepared for this.

05/01/2013 - Removal of Conditions - APPROVED!
