I finally got a touch, after almost one year in the vermont office. , but still no updates on the I-130 thus far

"Initial Review
On December 6, 2011, we transferred this case I129F PETITION FOR FIANCE(E) to another office for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition. "

We got a 2nd denial. THe reason is a criticue on everything was send as a reply on NOID (to a point of saying "you have 2 US citizen children with the beneficiary. Although these children are not covered under the AWA, the presence of these children increases the aforementioned risk to the beneficiary...", "the effidavits submitted by you and the beneficiary have the minimal weight" and so on).

Additionally, the denial dated on 13th of Dec was sent to our previous-previous address (Why?). So, we were very lucky that the person who got it went above and beyond to find us, and we got the letter a day before Christmas. SO far we spoke to our lawyer on the phone he gave us enough information to file an appeal Application Form ourselves, and his brief will follow shortly (you could do it withing 21 days since the Application is sent, but the Application has to be filed withing 30 days). That is what I mean, what was the reason to sent an appeal on the very old address? No, they do have a new address: 2 reasons, first I went to Infopass and changed it in person and have Confirmation, 2nd on the Court which has to do with my 1st Denial they already had the new address... And I mean a very old address! SO, is it just to waist a presious time for us to act during busy holliday season? Besides, that is the worst time for money... But we have to be greatfull for the fact that we got it - thank God still in time!

I know a lot of people had their files forvarded to Vermont. I wish the best luck to all of you - my case was not forvarded there, and as the Memorandum ststes, that the new rulls of adjudicating the AWA cases and heaving them to forvard to Vermont does not apply to the cases which are processed in the local offices (why in the world my case was transfered from CA SC to the local office is another little mistery). But the decision on my case was made by the local Director. So, hopefully you guys will not get any of the noncence we got in my Denial, because, from what I understand, Vermont has a special committee on the AWA cases.

Long story short. We will appeal for sure, and may be doing something else as well... Haven't talked to the lawyer other than on a phone yet... Again - holiday season. I'm so greatful that he (lawyer) is not on Hawai on vocation! THat would be a bummer!

So, lets be greatful for what we have and pray for the best!

I'm so sorry to hear about the denial in your case, thats nuts that they want to take a mother away from her children! The usa has just gone mad it seems, no logic anymore.

I was told by the ombudsman that a decision was made (not sure what it is) and to wait 30 days to get it, well its been about half that time and nothing yet. My online status still shows as pending. I put in a service request to check and they say its still pending/additional processing and to wait 3 months.....

So i get a new excuse from uscis everyday. I just hope its positive in the end

Dont give up, just keep trying!

can't imagine this is true. the federal government does NOT recognize gay marriage, and does NOT afford the same rights to homosexuals that are given to heterosexuals.

Well, that is true... See http://www.voanews.com/content/us-immigration-judge-suspends-deportation-of-gay-spouse-118741179/174610.html And you can find a lot of similar info online.

I think after almost 6 years married I also (and many other people in this forum who deal with missaplied AWA in immigration) deserve a break... While they stall like this our lifes go by.

As for my case movement... It is in a local office (why?), and was originally filled in Feb 2008, but transfered to the local office in March 2009. Since then we had an interview in August 2009 and NOID on which we replied in June 2010. And nothing since.

We go to the Infopass every 3-4 months. And I had contacted our Congressman. At first Congressman's representative was wery friendly and got back to me realy fast, but after getting detailes on a case, she got impossible to reach and didn't get back to us. I have called back a lot of times, but after telling who is calling always was sent to a voicemail box. So, one day I left an angry message, and, may be that was a reason, but I did get back a letter that they had contacted USCIS, but we need to realise that that is AWA case and it takes time.

We went to another infopass, and learned that our case went through level 1 adjadicator's decision and was folloved by supervisor's decision. The decisions were 1 advise to approve and 1 to deny. Now the case is at the Field Director's Office desk (we never got any letters or emails about any of that activity). Director's decision will be final. (The procedure of 3 officer's decision is for cases which end up in a local office only!).

It had been 3 month since a case is on the Director's desk. So, we went to Infopass again, and the level 1 officer went to supervisor to ask about my case. He came back with the reply that they know this case and if we think that USCIS does something wrong about a case, we sould contact Congressman or Senator, or, basically, sue them, if we wish. But there is no point to come here (to Infopass).

We tried to contact Congressman again, called and a left a massage a few times, but she never called back. For me, taht is a clear answer that our Congressman doesn't want to deal with AWA cases. Now, we soon will be moving to a different district, and I will try to contact the other Congressman, hopefully he will be a better help.

I feel like I need to be more proective and to contact everybody I only can, but writting in English is not easy for me, and my husband don't believe in any help. But i'm exausted - 5 years!!! He doesn't understand. The other day I read in a newspaper that homosexual couples are allowed to petition for immigration of a partner - they got it! Why can't we???

I just received a notice on July 2nd stating that my case has been transferred to local office. How long after knowing that you case was transferred to a local, you receive NOID? Thanks
