Can I get my green card back?

The first post seems to indicate that AOS was indeed filed after entry on the K-3 and a greencard was mailed to the ex-husband's residence.

I was once married to a U.S. citizen and we divorced soon after my green card was issued. It was mailed to his place in the states but he didn't wanna hand it to me back then, so I gave up on it.

However, all that is moot. You never maintained residency in the US or removed conditions. You will have to either get engaged or married in order to restart the process.

The green card was mailed to your ex's address and he didn't want to give it to you. Then he lost it or misplaced it. You never saw the card with your own eyes. Are you sure that it existed?

My Immigration Journey:

K1: June 2010 - December 2010

AOS: April 2011 - June 2011

ROC: April 2013 - August 2013

Naturalization: March 2014 - August 2014

This story doesn't make sense. Are you positive you had a green card? Have you actually had someone at USCIS verify that you had a green card?

If you had a K-3 visa, you would have had to file adjustment of status once you entered the States. You would have had to have your fingerprints taken. Even if you had no interview, it would have taken several months to get the green card in the mail. If you did not file this paperwork and you did not have biometrics done, you didn't get a green card.

Even if you did, a green card is to live as a permanent resident in the United States, NOT to use to visit the United States. Even if you had a green card, you spent the whole time living in Japan. This means even if the green card existed, you pretty much abandoned it by not having the United States as your permanent resident, and you THEN misrepresented yourself by using VWP to enter. The fact that you were even allowed to use VWP to enter makes me question whether AOS was ever filed.

You don't really have a shot at getting your green card, if it existed, reinstated. You didn't follow the rules of it and you didn't even attempt to remove the conditions, and by your own words you and your petitioner are only "sort of" together. If you want a green card again (which would ONLY be practical if you plan to live full-time in America), you'd need to have your spouse/fiance/boyfriend/whatever file for a CR-1 or K-1 visa depending on if you guys are married now or not.

I am sorry that my story may not make sense. As it was a long time ago, I may be missing some details... I had a hard time at that time and my memory is vague.

But I am sure that I had a green card. He didn't give it to me, but showed it to me by taking a picture of it. The reason I expected to get it back was, I visited Guam for vacation last year and the immigration officer said my green card was still valid. I thought it was weird as it should have expried. On their record I was a green card holder but they let me in with the visitor status. That is why I visited the immigration office last week to know what my current status is and if I can get it back. I agree with you guys that I won't be able to get it back most likely, but the immigration officer said it has a small possibility after checking our record. He may be wrong, but it is worth to try.

I was the one who left him and understand how much he was hurt and too emotional to let the green card go, so I just gave up on it. Also, I decided to stay in Japan for good even though I always wanted to go back to the states as my family was against our marriage AFTER they approved it and we got married. When I visited him last week, it was my first time in a long time that I could sleep deeply. He makes me happy. Also, I am comfortable to be with his family while I feel awkward to be with my family... I am not really happy when I am in Japan.

We would have to start over the long process, but I am fine with it as I still have a lot of things to take care of here. Time will fly fast.

Ah - suggest you start over, marry somewhere, file for CR-1 (IR-1?) visa, starting with an I-130 petition filed by your friend, after you two marry.

I didn't know that was even possible for a GC holder to enter the US as visitor, is this even possible? The POE Officer screwed on that by letting you in as visitor while having a valid Green Card.
