CR1 Visa in regards to daughter

Hello, my husband has his temporary green card (CR-1 visa) he has a 9 year old daughter whom lives with us now, cause we recently was awarded custody of her from the Bahamas. I completed a I-130 and I-485, but it was returned to me saying the app wasnt complete. Are these the correct forms? I also am doing a I-912 form, and USCIS told me I need to send one with both apps. So I now know that I need to do that. The only area that wasnt complete on the I-485 was the application type, I am not sure which one to check cause they all dont sound like they apply. Can you help?

Forget the I-912. You don't qualify. It can only be used for adjustment of status cases where INA 213A doesn't apply, meaning no financial sponsor is required. Since a financial sponsor is definitely required in this case, you don't qualify for a fee waiver.

Note that this is primarily for a spouse to adjust status, but it generally also applies to a step-child.

Check box "a" in part 2 of the I-485. The immigrant petition that will make a visa number immediately available is the I-130 that you're concurrently submitting.

Hi Jim, thanks for the info, so I have checked the top box of the I-485 (a). I also printed the info with the link that you gave me. Also is there any form that I can complete to show distress. Or do I just have to wait until I can get the fees.

No, you can't claim financial distress. This class of immigration requires a financial sponsor. You must submit an I-864 and you must have income and/or assets sufficient to meet the sponsorship requirements. If you can't meet the requirements then you must find a joint sponsor who can. Family immigration requires a binding contract with the US government promising that the immigrant will not become a public charge in the US. They will not accept any financial hardship pleas nor waive any fees for you because you're required by law to be financial stable enough to sponsor an immigrant.
