Hello,

If someone can help me to understand, i would greately apprciate it. I called the USCIS but they dont know (which is strange).

So, i recieved this notice, I-797 Notice of Action letter. It is an approval notice for the K1 petition and it has valid dates saying from this date to that date. What do these dates mean? Are they saying my fiance has to get the visa within these dates or she get an interview or make the appointment for the interview? In my case, we can only make appointment for the interview. After that who know how long it will take.

If this date is not enough time, can i request for an extension?

I don't know the exact answer to your question, but I can tell you that you have nothing to worry about. They will extend it on their own if it comes down to it to the best of my knowledge. I have seen this question before just can't remember the explanation for why they do this, but I do know you need not stress about it. Hopefully someone will come along with a more informative answer or you can try searching for something similar here on VJ.

When did you sent the I-129F? If it is a week after you sent the I-129 F..that is the acceptance notice telling you tat they received the package you sent them. it will take time before they send you RFE if there's any documents they need from you. Or with the case of NOA2 ( might be notice of approval the other way round) it takes about 3-6 months to get that before you are able to get a case number to be able to get an interview at the embassy.

Both you and your finace(e) will receive Pkg 3 and 4 from the US Consulate. Your fiance(e) will need to fill out forms and send them in to the Consulate along with some other documentation. Once the Consulate receives these forms he/she will receive instructions for Scheduling. If the interview cannot be scheduled within the validity period of the I-797 the Consulate will automatically re-validate the I-797 on the date of the Interview. I myself have emailed the US consulate regarding this same issue as my fiancee could not get an interview within the time frame on the I-797 and was assured that the I-797 would be re-validated.

It says it is valid from this date to that date, giving a time frame. What are they saying that i need to get accomplished in this date range. I+H commented that i should not worry about that because they will automatically extend it. If this is the case, it would take a lot of worry off of me.

It will automatically re-validate on the date of the interview even if the I-797 has expired. You have absolutely nothing to worry about.

to th e best of my understanding every thing he needs to send to the imagaration was sent with the I-129f.

There is not a package from the Phillipean consulate to the patitioner (i see it listed on the profile).

The benificary will get a packet but does not actualy need it either.

The patitioner does need to send a current I-134 to the benificary and the benificary has to fill out DS-156, DS157 and DS 15?k. There are details on the Phil consulate website as to what is needed.

The packet will have details of the I-129f petition,, if the packets dont get there before the interview just bring your own set of everything.

Her e is how it works. If your approved petition gets to the USE within that time frame and gets the interview set up, there is nothing you have to worry about the expiration. Let’s say the interview done and you petition is denied, and then the validation date will be effective, so that your petition expires on the date specified on your NOA2. However; if your petition is in AP, the time frame will be automatically revalidate for another 120 days. If the visa granted, then you will have another time frame, which is 6 month.
