Turkey releases names of IDF soldiers involved in Mavi Marmara attack

The Turkish government has released names and photos of the IDF soldiers who participated in the attack on the Mavi Marmara.

Turkey has requested an apology from Israel and compensation for victims of the attack, as well as the lifting of the Gaza blockade. After Israel refused, the Turkish government warned they would pursue criminal charges against the individuals who participated in the attack.

Turkey: IHH draws up list of IDF soldiers linked to Gaza flotilla raid

Speaking to the Today's Zaman daily, Turkish prosecutor denies list was result of an official investigation; directory includes 174 names identified using Facebook, Twitter accounts.

A Turkish public prosecutor said Monday that the Turkish IHH organization drew up a list – reportedly found through Facebook - of Israeli soldiers who were involved in the 2010 raid on a Gaza-bound aid flotilla, the Turkish newspaper Today's Zaman reported on Monday.

Istanbul Deputy Public Prosecutor Ates Hasan Sozen denied reports that the Istanbul Prosecutor's Office asked the National Intelligence Organization (MIT) to identify the soldiers and prepare the list.

“No state institution had such a request, nor does it have any information on this. The prosecutor conducting the investigation has given no such order,” Sözen said told Today's Zaman, adding that the list was handed in by an IHH lawyer.

Sozen was responding to a report in the Turkish Sabah daily that claimed that MIT received a list of Israel Defense Forces soldiers who participated in the raid on the Mavi Marmara, which resulted in the deaths of nine Turkish citizens. The report said that nearly all of the soldiers were identified using Facebook.

According to the earlier Sabah report, Turkish intelligence units, at the request of the prosecutor's office, launched what the report called “a commando hunt” on websites such as Facebook and Twitter, while cross-referencing using pictures taken of Prime Minister Benjamin Netanyahu's visit to the naval commando base which houses the unit which conducted the 2010 raid.

Next, the Sabah report claimed, Hebrew-speaking intelligence experts examined Facebook correspondences between soldiers suspected of taking part in the raid and their friends, with the soldiers' names confirmed by Turkish intelligence sources within Israel. A total of 174 names were identified using these methods, the report said.

The Sabah report comes amid an ongoing crisis in Israel-Turkey ties, one which Ankara says is perpetuated by Israel's refusal to apologize for the 2010 raid, which resulted in the deaths of nine Turkish nationals.

Speaking on Saturday, Turkish Prime Minister Recep Tayyip Erdogan warned that relations with Israel may “never be normal again," telling CNN's "Fareed Zakaria GPS": "We gave our warnings to Israel. This is the reason for war. This is something you cannot do in international waters. But as a great state, we have been very forgiving. That's why we have been very patient."

The IDF is taking legal precautions to protect soldiers and officers who participated in the operation to stop the Mavi Marmara Turkish passenger ship, senior defense officials said on Monday after Turkish news reports claimed intelligence agencies had compiled a list identifying 174 soldiers who could be prosecuted for their involvement in the operation.

The list reportedly includes commandos from the Navy's Flotilla 13 - better known as the Shayetet - as well as their commanders, Prime Minister Binyamin Netanyahu, Foreign Minister Avigdor Lieberman and Defense Minister Ehud Barak.

Earlier this month, the IDF Military Advocate General's office established a joint team with the Justice Ministry to study the Palmer Report which had justified Israel’s decision to impose a sea blockade on the Gaza Strip but also harshly criticized the navy’s operation to stop the Gaza-bound flotilla.

The report said that “the loss of life and injuries resulting from the use of force by Israeli forces during the takeover of the Mavi Marmara was unacceptable.”

The team is studying the legal consequences of the report and possible ways to provide protections to IDF soldiers. Due to this threat, Ehud Barak had tried to broker a compromise with Turkey in an effort to minimize the legal exposure to the commandos.

A senior IDF officer said at the time that the Palmer Report could potentially serve as the basis for criminal lawsuits against the commandos who boarded the ship as well as additional senior IDF officers, including commander of the navy V.-Adm. Eliezer Marom and the chief of General Staff at the time, Lt.- Gen. Gabi Ashkenazi, for their role in the operation.

Both officers are already vulnerable to legal action due to their involvement in Operation Cast Lead in the Gaza Strip two years ago.

Gaza flotilla probe to examine IDF's handling of past war crimes charges

Investigation by Turkel Commission meant to determine if IDF soldiers would be exposed to prosecution in foreign countries according to international law.

A governmental commission that investigated the Israel Defense Forces' 2010 raid of a Gaza-bound flotilla is now probing the army's ability to investigate war crime charges levied against its own soldiers.

International law stipulates that for soldiers of one country to be prosecuted by another the country in which the war crime was committed has to be proven as unable to properly investigate the incident.

In order to legally verify that indeed the IDF has conducted a thorough investigation of soldiers accused of war crimes – a determination that would defend IDF soldiers from foreign prosecution –the Turkel Commission, headed by former Supreme Court Justice Jacob Turkel, requested military advocate general Danny Efroni to hand over information concerning 50 past cases in which IDF soldiers were accused of war crimes.

The Turkel Commission will treat these 50 cases as a sample selection for investigating the way in which the Military Advocate's office treated claims of war crimes in the past. In addition, the commission will look into the way in which those cases were treated by the military's internal affairs unit and whether or not the State Attorney's Office chose to pursue or close the case.

The Turkel Commission is expected to go over the details of the various cases, including the operational briefings held by the units themselves. Some of the files pertain to criminal investigations which arose in the wake of the IDF's raid of the Turkish aid flotilla in 2010, including instances in which soldiers were accused of stealing the personal belongings of flotilla participants.

Something about the Tower of Babel...
:yes: Nimrod was the ringleader of it; as final punishment for it (not recorded in Bible), he was killed a few years later at age 40 by his quarry (a wild boar) while on a hunting expedition--and became the inspiration for the Sumerian/Assyrian/Babylonian legend of Tammuz/Dumuzi.

FYI, even in US I am aware of one person who was given that name--Nimrod McNair who tried (and lost) a bid to become GA's governor (I think that election was in 1994 when I lived/worked in Atlanta).

Facebook, eh? I'm so happy to see that the Turkish justice system has established an extremely high standard of proof in order to protect the innocent from being falsely accused.

They want an apology? This is like a guy who walks into a bar, talks trash to someone, gets his #### kicked, then comes back demanding an apology. Maybe if they hadn't instigated the situation by their own actions they would be owed an apology.
