Greeting Everyone,

My I-360 as a Battered Spouse has been recieved at VSC on this Friday. Although it is too early to expect anything, I wanted to know how long does it take to process an I-360? I know, generally I will have to file MTR once the I-360 is approved, does anyone know if I can file MTR with the BIA based upon simply a Prima Facia Determination?

Hi case,

I have been waiting for over 9 months... Every case differs, what do you mean by MTR? You have to file the I485 if you havent done yet with your ex-husband... also I765, same thing, if you havent done yet.

nov 04 Went to interview by myself, told officer will aplly for vawa

11/04 I485 touched (still on initial review)

11/21 officer called lawyer about the I485 (btw: really nice IO)

12/10 apply for VAWA, without background check

12/11 lawyer drop off a copy of I360 for the IO

12/15 Prima faice received

12/18 sent background check, also sent a letter to IO asking to expedite the I485 to vermont to be linked with I360

12/31 I360 touched

08/04 Apply for EAD renew

08/18 receive NOA

08/26 new card ordered

08/31 new card ordered (again??)

09/01 notice of approval of I765... (where is my VAWA approval??? God help me...)

09/03 EAD arrived in the mail!! ufa!

10/03 Sent letter to renew prima facie and inquire about vawa status.

10/05 I360 touched- changed to "Request for evidence review" (WTH????)

11/27 Recieved prima facie extension

11/30 VAWA APPROVED!!!! yupiiiiiiiiiiiiii12/04 I360 Touched

12/22 Interview noticed for 01/23/12

12/26 Interview canceled by USCIS

12/31 New interview notice for 01/30/12

01/31/12 Interview and new biometrics done!!!

Hi case,

Thank you so much for your feed back, I was actually ordered removed from United States by an IJ. In the presence of Final Order of Deportation in my file, technically I cannot apply for concurrent I-485 etc. I will have to wait for I-360 to get approved by VSC. Once that is done, I will then file a Motion To Reopn my previous case with the BIA so that FOD can be cancelled. I have an EAD from previous case that is not going to cancel until my I-360 approves.

WE ARE IN THE SAME BOAT...

I already received a Final removal from BIA and my I360VAWA is still pending...

lets say It takes about a year or a year and half to get approved sometimes less than 7 months.

so tell me...

what happened? who call ICE on you?
