I married my wife a month ago in the usa, although i am a british citizen can i stay in the us whilst applying for a visa?

Only for your authorized length of time. When your authorized time in the US expires, you must depart the US.

Our journey:

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

January 28, 2014: Production of new Green Card ordered

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

so even though i am back in aBritain i can only go back on visitor visa ? then ihave to leave and wait until the visa process has been complete?

Since you are a British Citizen, you should be eligible to use the Visa Waiver Program (VWP) which would allow you to stay in the US for 90 days; you would have to leave when that 90 day period is over. Is there any reason that would preclude you from traveling on the VWP?

Even if you were to arrive on the VWP, there is no guarantee CBP would allow you entry, it would be a good idea to carry proof of ties to the UK should such ties be asked for by CBP.

That's your electronic system for travel authorization (ESTA), not VWP.

but wasnt sure what we had to do so thought best way was to return home

Returning home was the proper thing to do. You can visit on the VWP while this process is in progress but you will have to return home when your authorized stay on the VWP in the US ends, which is 90 days after arrival.

My husband is British and we got married in the US. We filed immediately and he left a few weeks after but he's been coming and going since then with no real issues. It all depends on your own circumstances (are you employed with significant ties to the UK?) and also on who you get at the immigration desk whether they let you in. Hubby is always a bit nervous going through immigration but hasn't had any problems. Just make sure you have evidence of your pending visa petition/application.

no i have no ties that i couldnt walk away from, i have just filled out the g325a form i think it is an i have sent that back to my wife to get the process underway, i was just wondering if there was a way i could stay in the us whilst all the visa stuff is being processed but am guessing i cant other than the 90days maximum

only real ties i have here are my unicersity course which doesnt finish for another 2 years

You can use your university course and continues enrollment in the classes as the ties to your home country.

University course is not a rock solid ties to your home country, but I guess you can use that and if you have not overstayed any of your previous VWP you should be ok.
