I plan on vising to America in a few weeks to be with my fiance. When I get there he is going to apply for the K-1 visa for me, and I will travel back to Canada for my interview when necessary (or before the 6 month period in which I am allowed to stay). I am only going as a long visit right now, not for permanent residency, however once I get the visa I will be moving permanently. Well, my mother is going to drive with me to the US as it would be cheaper for her to drop me off and drive back home, and we are not too far away. Would this be a problem at the border? Also, when my interview comes around, and I travel back to Canada, how long does it usually take for the visa to get accepted? Will it be a problem for me to cross the border to the US with my fiance visa once I get it, since I previously spent a few months in the US visiting? Also, once I get the visa, I can plan to move permanently with no problem right?

I am a little stressed, I don't want to risk being barred from entering the US. We have been in a long distance relationship for almost two years and are really fed up (he was unable to travel to Canada due to a pety theft charge on his record, so we have been waiting for his rehabilitation papers which are taking way too long!) We really want to get our life started.

If you are from Canada then from what I read you don't need a visa to visit the states but can stay up to 6 months. You need to read the Canada forum. On that note yes you can visit him and stay and apply for the 129f petition you will need to have some papers for him to send off with the application so it's a good idea you are here when he fills it out. Inky hopefully will help out here. With that said once you are approved 5-9 months some take the petition then goes to NVC for a case number and then you are notified and you have interview in Canada and if approved get visa. This on top of approval of 129f can take another few months. Everyone's case is different but if you have no RFE and no problems then it should run smoothly for you.

If you are Canadian citizen, entry into the USA without a visa, before and during the K1 process is acceptable, as long as you don't overstay your visit in the USA.

Once the K1 is approved, you are legally supposed to stay with US borders and not to travel outside USA unless you get a waiver from immigration.
