Your USC brother in law files form I-864. He will need to include an explanation as to why he was not required to file federal income tax returns.

If you live with your brother in law, you can file Form I-864a as a household member.

If you do not live with your brother in law, you will file Form I-864 as a joint sponsor.

Your brother as the primary sponsor will complete an I-864. You as the joint sponsor will also complete an I-864.

A brother in law does not qualify as a household member for the affidavit of support.

Both the petitioner (US citizen spouse) and the joint sponsor will complete forms I-864.

Thanks Anh Map. Only certain family members can be household members. A brother in law is not one of them.
