Letter of consent; proof of relationship ?'s

Quick questions, since I'm filing my I129 soon, Im wanting to know if I need to have a letter of concent for my fiance. I dont want to get an RFE! He's 17, will be 18 in March. Also if it is needed, does it have to be notarized? Can it be a copy or does it have to be an original letter?

Im thinking of faxing it to my mother in law, in english, having her sign it and then faxing it back to me.

Also, since my fiance EWI'd three years ago (living with me that WHOLE time), what can i use for evidence? We have a child together, lease contracts, car recipts, rent reciepts, pictures. But I've never been to Mexico, seeing how hes always been here. (So I dont have stamps, boarding tickets, emails, etc; does it matter?) Im planning on going with him when he leaves (hopefully interview is before his 180 days are up) and that will be the first time I meet his family and such. (I'll use that for evidence of ongoing relationship.) What else could be used as evidence? I wish I could have gone the K3 route, but seeing how he doesnt have his parents here to give him consent for marriage, we decided on K1.

I am sure you will tons of answers, but, I would recommend providing evidence of living together, pictures, any joint statements .. engagement ring receipts,pictures with him less than two years ago. Anything over 2 yrs, shows you haven't been together for that period, and raises concern, unless,you provide evidence to support your case.

May be helpful to speak to an immigration attorney in your area and seek some guidance..

I am sure you will tons of answers, but, I would recommend providing evidence of living together, pictures, any joint statements .. engagement ring receipts,pictures with him less than two years ago. Anything over 2 yrs, shows you haven't been together for that period, and raises concern, unless,you provide evidence to support your case.

Well everything I mentioned, falls into the "2 year" category. ie: Lease contract from parents is from June of this year, the one from our Apartment is from Sept '10 through May '11; Car payment dates are from this year too. (both names mentioned) My daughter was born March 15, 2010; I dont think I have anything in this packet from over two years, other than one or two pictures when first started dating in '09.

Maybe someone else can chime in here but I understand you must be of legal age for a K1 visa. I would assume that to be 18.

So that means what exactly? WAHH I feel dumb! :( He would be eighteen when he came back to the US to marry me, so he'd be legal of age. And the first statement refers to people under 16.

You need proof of consent to marriage appropriate to the jurisdiction in which you will wed.... meaning that you need to find out what the age of consent is in the jurisdiction where you will have your wedding performed. If it is 18, and your fiance is 17, you will need proof of parental consent to the marriage. (see USCIS form I-129F Instructions. General instructions, section 5, subsection C http://www.uscis.gov/files/form/i-129finstr.pdf )

Should it be notarized? Also, I just want to fax/maybe email it to his parents, and it doesnt state is has to be an original copy with signature, either way id have to make another one for consulate, so a copy is okay maybe? I dont want to wait for it to arrive in the mail, since it seems to take forever to get here from Mexico.

On what state are you getting married? Your soon to be husband will turn 18 in 6months, K-1 will usually finish in 9 mos so check State if it requires you such thing and check the states's rule about it if it has to be notarized or not.

On what state are you getting married? Your soon to be husband will turn 18 in 6months, K-1 will usually finish in 9 mos so check State if it requires you such thing and check the states's rule about it if it has to be notarized or not.

Thanks, I live in Missouri and the permitted age for marriage is 18. But if you're getting married at 17, it requires both parents to sign a consent form. We're getting married when he comes back, which by that time he'll already be legal of age to marry me. Thats why it confused me. :hehe:
