Traveling after Biometrics, with AP

Hello,

I'm planning a trip outside the U.S. using my travel document (AP) to visit family, right after my Biometrics appointment. I have a few questions that might sound silly, but it's better to be safe than sorry :)

1. I'm adjusting from F1 Student visa. As far as I know, I never overstayed my visa. I sent my AOS package while I was on status. When I received my NOA for I-485, I showed it to the International students coordinator at my school and then she terminated my SEVIS. She asked me if this was OK and I said yes. I guess there is no problem, right?

2. My Bio. appointment is 10/17/11. How soon after Bio. appt. will I receive the letter for the AOS interview? I'm just planning to travel for 8 days or so.

3. Which immigration documents to I need to bring to reenter the US? I'm going to bring everything just in case.

I would like to know also if there is anyone who had adjusted from F1 and traveled with AP before their AOS interview.

Thank you!!!

Do you think I can travel and reenter the US with AP, without getting into trouble, even if my SEVIS was terminated? (Sevis was terminated after I got NOA for I-485). Or should I wait to travel until I get my GC? Just to be on the safe side? Thanks.

You should be fine to travel, as long as you wait to have the physical AP. Remember, just doing biometrics doesn't allow you to travel - you have to get the advance parole document before you can leave the US. It can take from a couple weeks to a month or two after biometrics to get it.

Your SEVIS being terminated doesn't affect your travel abilities at all. It was probably terminated because once you submitted your AOS paperwork, you're no longer an F-1 student anymore. Even if your SEVIS was not terminated, you couldn't use your F1 to travel and return to the US anymore. Both your F1 and I-20 became invalid once you submitted your AOS paperwork. You're in a kind of a limbo status at the moment, but you are authorized to be in the US and you can continue to study with your pending AOS. If the AOS is denied for whatever reason, you would either have to get your student visa reinstated, or leave the US and try to get a new one (which would be hard at that point, given your AOS application).

Anyway - if it's a straight forward AOS from F1, you'll most likely have no troubles getting your GC. When you get your AP, you can travel with that and probably won't need anything else. I traveled with my AP before my AOS interview, and actually after it too, and just in case I took with me my marriage certificate and my NOA1. I never needed those though, just my passport and AP.

Thanks for your answer. I already have my AP in hand. I just wasn't sure if it was OK and safe to travel.

It's good to hear from someone who had a similar experience.
