Hi there,

Our K-1 application is currently in "Administrative Processing" and we are unsure as to when it will be approved. If it is approved and my fiance comes here in the next few months, he will need to go back to Albania for his sister's wedding in January. When do you apply for advance parole? Is it necessary after you apply for adjustment of status? Does he need to be here when we apply for Advance Parole? Any info you could give me would be great!

He will arrive in the US on his K-1 visa

He will marry you

You will apply for adjustment of status - when you do that you may also apply for the advanced parole.

If he leaves before he has his advanced parole, he will not be readmitted into the US

Advance parole is only issued while an alien's adjustment of status is pending. You can't apply for advance parole before you apply for adjustment of status. You can (and should) apply for advance parole at the same time you apply for adjustment of status - there's no extra fee for the advance parole when you apply at the same time as the AOS. Two or three months is typical.

If your fiance absolutely must be in Albania for the wedding then I suggest he waits until after the wedding before coming to the US, presuming he get's a K1 visa before the wedding. The K1 is valid for six months.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
