Hi,

I've been looking on the forum for a while and haven't found an answer to my question so, I'll ask it here and hope that maybe someone can answer.

I am a US citizen living in Canada. I am working on bringing my wife down to the States with me. We have filed the I-130 and Packet 3. I am self-employed here in Canada, and plan to stay self employed when I move back to the States. I have no US income for the last 3 years, but I have made $50,000-ish up here. We also have $23,000.00 CAD in savings.

My questions is, will I need a joint sponsor? Should I move our savings to the US?

It all depends if you can demonstrate that your income will continue when you move to the US or not.

Have you been filing US tax returns? US citizens are required to file federal tax returns on all worldwide income. Based on your earnings of $50,000/year, you should have been filing US federal tax returns. With the Foreign Income Tax Credit, you will probably end up owing zero in taxes.

If your income will continue after moving to the US and the required federal tax returns are filed, you will probably not need a joint sponsor.

There is no need to move your savings to the US.

In addition to Jojo's excellent advice, don't forget that you must be domiciled in the US in order to qualify as a sponsor. If you haven't maintained your domicile in the US while you've been in Canada (it sounds like you haven't) then you need to either establish domicile in the US before your wife get's a visa, or show that you have taken steps to establish domicile and will be entering the US at the same time or before your wife.

Thanks for the replies. So, should I just play it safe and have my Father be the joint sponsor? Do we both fill out an I-864? And do I list my Canadian income on the form?

I am getting my taxes done next week so I will have the returns to attach to the form.

Also,

Here's what I plan to do to establish 'Domicile':

1. Open a bank account in WA

2. Draw up a rental agreement with my parents and have them sign it

3. Get a business licensee in WA and work with a few clients down there (I already have some.)

4. Buy a car down there and get insurance with my parent's address

Any other ideas? Are these good enough?
