Dear VJ members,

My fiance does not have money in the Bank Account but has a good work and makes over $2000 a month. Can my fiance get the bank statement without having money in the Account to use for Affidavit of Support or what ?

If your fiance meets the guidelines with their job then it shouldn't be a problem. They just need proof of the job with paystubs and a letter from the employer. If the guidelines are met with that income then no co sponsor is needed.

Is your fiance paid in cash... or does he get paid into his bank account, and then do other things w/ the money?

Does he file tax returns based on his income?

If he can get a letter from his employer and/or paystubs/tax transcripts, you should be in good shape.

If your fiance meets the guidelines with their job then it shouldn't be a problem. They just need proof of the job with paystubs and a letter from the employer. If the guidelines are met with that income then no co sponsor is needed.

BUT I WANT ASK WHAT IS "guidelines with their job" AND A LETTER FROM EMPLOYER : can the letter be an employment letter or an Appointment Letter ?

KRISTIN, THANKS FOR THE RESPONSE. MY FIANCE GETS PAID DIRECTLY INTO THE BANK ACCOUNT AND SPENDS THE MONEY ON BILLS AND OTHER THINGS. ALSO TAX RETURNS WAS BASED ON THE INCOME.

THE EMPLOYER (GOVERNMENT HOSPITAL) SAID THEY DON'T GIVE LETTER BUT THERE IS PAYSTUBS / TAX RETURNS EVIDENCE.

WHAT DO YOU SUGGEST ?

even if they get direct deposit into their bank account there is still a paystub record whether it is mailed to them or online like mine is to print they stilkl have some kind of paystub showing each pay put into their account...those along with tax records and a letter from your employer stating the salary and that they work for them should suffice that requirement of proof that it meets the poverty guidelines without co sponso

OK - got it. At least there is record of the money :-)

Get a hold of recent paystubs from your fiance. Several months should suffice in showing consistent employment. If your finace calls the IRS, he can get free tax transcripts that provide employment and money earned. There is an automated number he can ring... if you just search 'tax transcript phone number' or something of the like here on VJ, it will show up. Some people have the number in their email signatures, too. They are free and super easy to obtain. Just takes a few weeks (1 - 2), unless your fiance has access to a fax machine and can receive them straight away.

Just do not fill out portion on bank accounts. it is not necessary. You need to fill it out ONLY if you are using cash assets to supplement insufficient income. In your case you are fine. Just skip it.

The employment letter is optional, I didn't use one, I just submitted most recent tax return and last six paystubs

1/21/2011: Married in Tacloban City

USCIS (135 days)

2/23/2011: sent I-130 and I-129f

3/6/2011: received NOA1 for I-130

3/16/2011: received NOA1 for I-129f

6/17/2011: received NOA2 for I-130 and I-129f

NVC(74 Days)

7/18/2011: NVC received and case number assigned

7/20/2011: NVC Administratively closes I-129f

7/30/2011: emailed DS-3032

8/24/2011: FINALLY received AOS Fee and PAID also sent DS-3032 for the third time (PAID on 8/25)

8/26/2011: Received DS-3032 Acceptance email

When I did this, I only sent the paystubs and the tax forms. Make sure he's not on/below poverty level.

THANKS SO MUCH. I AM RELIEVED A BIT. MEANWHILE WHERE ON THE FORM I-134 ARE we GOING TO WRITE THE MONTHLY / ANNUAL INCOME.... this is because "San Diego" said the bank info is optional and we can skip it if we meet up with the Poverty Guideline... :help:
