Driver license and I-94 expiring before AOS interview

Hello,

My wife entered the U.S. with a K1 visa on June 24 and we now have (after marrying and filing for AOS) the interview on October 18. Both her I-94 and her driver license are expiring today (September 22). Do we have to do anything here? I'm especially concerned about the driver license.

2011.07.13: I-485 (AOS) / I-131 (AP) / I-765 (EAD) applications mailed

2011.07.18: Notice of Action (applications received)

2011.08.13: Biometrics appointment

2011.09.08: Letter from USCIS (“Request To Appear For Initial Interview”)

2011.10.18: Interview (result: AOS approved)

Once the USCIS has received a petition for Adjustment of Status and has acknowledged this by issuing a Notice of Action, the applicant enters a period of authorized stay.

It is unlawful to drive without a valid driver's license. For that reason the new immigrant should not apply for a license before AOS has been adjudicated, even if it's possible in the state she is seeking residence in.

Your wife could have used her German license until 10 days after becoming a resident. However, if she already got an Arizona license and it's about to expire today, this will be in the system. So when stopped, she can't just show her German license and be sure that everything will be fine; if the cop finds out that her Arizona license is suspended, he will almost certainly issue a ticket.

Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . I could renew my DL in FL with the first NOAs (USCIS received our package of I485,I130 ...), valid passport, marriage certificate and proof of address. Of course is temporary for one year, but now I have the GC I would be able to renew next year. I suggest you if your wife cannot renew yet her DL not to drive, untill she can renew, or find out if is legal to drive with a foreign DL, so if she gets stoped won't be issued a ticket of no valid DL or worst get arrested, for NVDL or driving with expired DL.
