I'm currently in the states on a J1 visa and applying for change of status and EAD because I'm now married to a US citizen. I'm currently working and my J1 expires on 30 November. I'm a little worried my EAD wont arrive before 30 November so that means I will have to quite my job until I receive it.

Is having an existing job grounds to expedite an EAD? does anyone have any experience with this?

Working without authorization will not be made an issue of at AOS, so if you thought about quitting your job, that would be just silly.

thanks for your reply. so are you saying I am legally able to work after my J1 expires and before I receive my EAD? what paper work do I show to my employer to prove this? I think they might let me go because they may not believe I am legally able to work

Somehow, and I'm not to sure but question the 2 above replies. Something don't seem right. But I feel an Expedite for a work card is not posible. (EAD) .

I would be very careful and wait for other replies. What seems simple could be complex or just Normal. But, wait for more replies

You will not have any legal document to provide to your employer after your current EAD expires and before getting the new one to show that you are allowed to work - because legally you are not. You need authorization for working here, and you won't have that.

If your employer is asking you to provide proof of authorization after your current EAD expires, you will just have to wait until the new EAD comes - maybe they'll let you take some type of a break/leave in between..?

You can try to expedite your EAD, but you'll need to obtain a letter from the employer stating you have a job offer waiting. Even then, it'####### and miss - but you won't lose anything by trying to expedite it. Usually EAD comes within 90 days of filing the AOS paperwork, so if you get the papers in the mail by, for example, early October, you should have your EAD by the end of December at the latest, assuming you won't get an RFE along the way.

I would wait it out. You still have 2 months, and generally EADs don't take longer than 90 days. Have you already submitted everything and are now just waiting?

If you get to the point where your EAD has not arrived, I would ask your employer if you can take a short leave until it arrives again. I've had employers do this for co-workers who had to renew work visas. I know some employers are probably more flexible on this than others but if they like you and you let them know it should be longer than 2-4 weeks, that's still faster and easier than finding someone to replace you!!

my application was received last week so there might be a chance I will receive it before November 30, but i'm going to try and expedite it after my biometrics i guess I might as well try
