Hello All,

Working on my wife's AOS and I have a question.

Does here son, who is 5 years old, and entered on a K-2 with her K-1, need a separate I-485? Or is he included on her I-485?

12/28/09- Sent packet to VSC FedEx Priority overnight

12/29/09- VSC received and issued NOA1

01/03/10- Touched

04/20/10- NOA2!!!! Finally. No touch Straight to NOA2

04/22/10- NVC Received

04/23/10- NVC forwarded to Embassy in Kiev

04/26/10-Embassy in Kief Received

04/30/10-Embassy entered in System

06/07/10- Medical scheduled

06/09/10- Interview scheduled

06/09/10-APPROVED!!!

06/24/10-POE Newark

08/28/10-Married to my love, Allie

She will need to list her son on the I-485 in part 3B with the indication that he will be applying with her. You will also need to complete an I-485 for her son as well. Since he is under the age of 14, however, you will NOT have to provide a G-325A for him as part of the package. When you send in the forms make sure that you mail the applications together, but that there are separate checks for the fees ($1,070 for your wife and $635 for her son).

correct, they are 2 separate petitions, 2 packages, now you are filing for him as your stepson.

Just a follow-up on this question. I have added my 2 kids on I-485 and ticked the option 'Applying with you?'. They are a K-2 visa holder. My question is, do I also fill out individual form I-485 for each of them even if they have not yet entered the U.S.? If so, what other forms do I have to complete for them? Or, should I just leave them out and just let them enter the U.S. under their original K-2 visas?

Should this follow-up question had been addressed already, please advise the link.
