Responding to RFE, input?

Hello everyone,

Hoping to get your thoughts on my responses to the RFE we received a couple of days ago, I'm not going to list everything like it was sent because it's too long but I would like to list what I responded:

1) They asked for my husband's 2010 tax returns but he did not work, the written explanation I wrote:

In reference to your kind request for a complete Federal Income Tax Return for the most recent tax year (2010), kindly note that during the year 2010, I made no income of any type and was unemployed, thus I was not required to file an income tax return with the Internal Revenue Service.

2) Proof that he is currently employed, we sent in an employment letter but they said we submitted no evidence so we will resend it, what I wrote:

Kindly find enclosed the following:

Petitioner/Sponsor’s letter of employment stating dates of employment, nature of the job, salary earned, and number of hours per week worked.

Pay stubs for the past 3 months.

3) I submitted my foreign job as a source of income even though I don't work in the US, I work remotely with my job in Jordan which I don't think was clear, so they asked me for tax returns, etc. My explanation:

In reference to including my income as part of the household income, please allow me to apologize for this inconvenience and further explain the situation. I regretfully admit to misunderstanding that the income has to be from a company based in the United States while authorized to work in the United States. Kindly note that the company I work for is based in Amman – Jordan and it is the company I have been working for since 2009 during which I lived there. I have been in the United States since May 2011 and my employer changed my work status from full time to part time because I am not physically present in Amman and I continued to work for them remotely via email. I mistakenly believed that I could include this income. I have never worked in the United States as I am aware that I am not legally allowed to until I receive my EAD.

As a result of this, I understand that my income shall be discarded and not included as part of the household income and have accordingly adjusted and included a corrected copy of the I-864 excluding that amount.

4) Asked for my foreign birth certificate, my response:

In reference to your kind request for my foreign birth certificate, kindly find it enclosed in addition to the English copy. Both certified copies have been obtained by the Jordanian Ministry of Interior – Civil Status and Passport Department which is the official government entity that issues birth certificates for Jordanian citizens.

for #1, did he collect unemployment? Those payments are still considered income and a return should be filed as such. When I was on unemployment, my checks all had withholdings and needed to be filed.

No he didn't collect unemployment, he lived off his savings, I was visiting him for 5 months during that year

you could possibly show bank statements showing the withdrawals from his savings over that time??

They only asked for a written explanation of why he didn't file for taxes, I believe they do some checking around to verify that he didn't work during that year
